NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of the Power of Sale contained in that certain Security Deed given from Richard A. Garner and Heather S. Garner to Branch Banking and Trust Company, dated 05/24/2013, recorded 06/17/2013 in Deed Book 1398, Page 2022, Richmond County, Georgia records, said Security Deed having been given to secure a Note of even date in the principal amount of SEVENTY EIGHT THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($78,500.00), with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, within the legal hours of sale on the first Tuesday in December 2015 by Branch Banking and Trust Company, as Attorney in Fact for Richard A. Garner and Heather S. Garner, all property described in said Security Deed including but not limited to the following described property: ALL THAT LOT OR PARCEL OF LAND WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF RICHMOND, FRONTING A DISTANCE OF 53 FEET ON STARNES STREET; AND BEING COMPOSED OF: THE SOUTHERNMOST 100 FEET OF LOT 16; THE WESTERNMOST PORTION, TRIANGULAR IN SHAPE, OF LOT 17; ALL IN BLOCK D, HECKLE PLACE SUBDIVISION, AS SHOWN ON A PLAT RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF RICHMOND COUNTY, GEORGIA, IN REALTY BOOK 7-T, PAGE 297; AND A STRIP OF LAND LYING TO THE SOUTH THEREOF, FRONTING A DISTANCE OF 53 FEET ON THE NORTH SIDE OF STARNES STREET AND EXTENDING BACK BETWEEN PARALLEL LINES A DISTANCE OF 10 FEET TO A REAR WIDTH OF 53 FEET, WHICH WAS ORIGINALLY SHOWN AS PART OF STARNES STREET UPON THE AFORESAID PLAT, BUT WHICH WAS QUIT CLAIMED AND ABANDONED FOR STREET PURPOSES BY THE CITY COUNCIL OF AUGUSTA BY DEED RECORDED IN THE AFORESAID CLERK`S OFFICE IN REALTY BOOK 10-L, PAGE 564; REFERENCE BEING MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND LOCATION OF SAID PROPERTY; SAID PROPERTY IS CONVEYED SUBJECT TO AND WITH NOTICE OF THE FOLLOWING MATTERS: A) DRAINAGE EASEMENTS, BUILDING SETBACK LINES, AND ALL OTHER MATTERS SHOWN ON THE PLAT OF RECORD; B) GENERAL UTILITY EASEMENTS AND ROAD RIGHT-OF-WAY GRANTS AND EASEMENTS; SAID PROPERTY IS HEREBY CONVEYED SUBJECT TO ANY AND ALL OTHER EASEMENTS, RESTRICTIONS AND RIGHTS OF WAY OF RECORD IN THE AFORESAID CLERK`S OFFICE; SUBJECT TO ANY EASEMENTS OR RESTRICTIONS OF RECORD. Said property being known as 2005 STARNES STREET, AUGUSTA, GEORGIA 30904 according to the present numbering system in Richmond County. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the title to said property: any superior Security Deeds of record; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed.
