POWER IN SECURITY DEED

Under and by virtue of the power of sale contained in a Deed to Secure Debt given by DAVID OAKES and TAMMY OAKES now known as TAMMY BRADLEY to GLENN HOPPER and HILDA M. HOPPER dated January 28, 1999 and recorded in Deed Book N-18, Pages 181-183 Rabun County, Georgia Records, subsequently assigned to Glenn Hopper, conveying the after described property to secure a note dated January 28, 1999 in the original principal amount of FIFTY-NINE THOUSAND SEVEN HUNDRED AND 00/100 DOLLARS ($59,700.00), with interest thereon as set forth therein, there will be sold by the undersigned at public outcry to the highest bidder, for cash, before the courthouse door of Rabun County, Georgia, within the legal hours of sale on the first Tuesday in December, 2015, the same being December 1, 2015, the following described property:
All that tract or parcel of land lying and being in Land Lot 75 of the Second Land District of Rabun County, Georgia, and being that 0.95 acre tract as shown on that certain plat of survey prepared by William F. Rolader, Georgia Registered Land Surveyor No. 2042, dated August 4, 1998, which is recorded in the office of the Clerk of Rabun Superior Court in Plat Book 42, Page 118. Reference is had and made to said plat and recorded of the same for a more full and complete description of the property herein described.
This conveyance is made subject to restrictive covenants of record in the office of the Clerk of Rabun Superior Court.
The debt secured by said deed to secure debt has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which may be disclosed by a current accurate survey and inspection of the property, any easements, assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above. The entity that has full authority to negotiate, amend and modify all terms of the Deed to Secure Debt with the Debtor is: GLENN HOPPER located at 1913 Wolffork Road, Rabun Gap, Georgia 30568. The secured Creditor is not required by law to negotiate, amend or modify the terms of the Deed to Secure Debt.
To the best knowledge and belief of the undersigned the party in possession of the property is TAMMY BRADLEY f/k/a TAMMY OAKES and/or any tenant or tenants in possession and said property is located at Land Lot 75 of the Second Land District, Rabun County, Georgia 30523 and is designated as being Rabun County Tax Parcel #041A-106.
The sale will be conducted subject to: (1.) confirmation that the sale is not prohibited under the U. S. Bankruptcy Code; and (2.) final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt. This 30th day of October, 2015.
