NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF RABUN
By virtue of the Power of Sale contained in that Security Deed executed and delivered by Larry W. Jarrett and Patricia M. Jarrett to United Community Bank, dated April 10, 2008, recorded in Deed Book N-33, Page 380, as modified by that certain Modification of Security Deed by and between Larry W. Jarrett, Patricia M. Jarrett and United Community Bank, dated September 10, 2009, recorded in Deed Book K-35, Page 357, as further modified by that certain Modification of Security Deed by and between Larry W. Jarrett, Patricia M. Jarrett and United Community Bank, dated April 21, 2010, recorded in Deed Book C-36, Page 631, Rabun County Records, conveying the after-described property to secure a Note in the original principal amount of One Hundred Fifty Six Thousand Nine Hundred Fifty Dollars and .98/1.00 ($156,950.98) with interest thereon as set forth therein, there will be sold at public outcry before the Courthouse door in said County by Commercial Funding Solutions III, LLC, as assignee of United Community Bank by virtue of that certain Transfer and Assignment of Deed to Secure Debt from United Community Bank to CF Southeast, LLC, dated April 18, 2011, recorded in Deed Book F-37, Page 236, as further assigned per that certain Assignment of Security Deed from CF Southeast, LLC to Commercial Funding Solutions, LLC, dated January 7, 2014, recorded in Deed Book Q-40, Page 520, and as further assigned per that certain Assignment of Deed of Trust from Commercial Funding Solutions, LLC to Commercial Funding Solutions III, LLC, dated August 26, 2015, recorded in Deed Book F-42, Page 355, Rabun County Records, during the legal hours of sale on the first Tuesday in December, 2015, to the highest bidder for cash, the following described property, as follows:
All that tract or parcel of land lying and being in Land Lot 75 of the Fifth Land District of Rabun County, Georgia consisting of 0.20 acre tract, including all improvements located thereon, as more particularly described on a plat of survey dated January 18, 1978, prepared by T. Lamar Edwards, Georgia Registered Land Surveyor No. 1837, said plat recorded in Plat Book 14, Page 192, Clerk's Office, Rabun Superior Court, reference to said plat being for the express purpose of incorporating its description herein.
The said debt secured by the said Security Deed being in default, said sale will be made for the purpose of paying the same and all expenses in connection with this foreclosure including but not limited to all accrued and unpaid interest, attorney's fees and expenses of sale.
Upon the best information and belief of Lender, the above-described property is in the possession of the Borrower, and/or tenants of Borrower or other persons or entities in possession with the consent or acquiescence of Borrower, and the property is commonly known as 7335 Highway 76 West, Clayton, Georgia 30525, according to the present system of numbering properties in Rabun County, Georgia.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Midwest Servicing, Inc., as servicing agent for Commercial Funding Solutions III, LLC, 200 CrossKeys Office Park, Suite 230, Fairport, NY 14450 at 585-377-2810. Please understand that the secured creditor is not required to negotiate, amend or modify the terms of the mortgage instrument.
Said property will be sold as the property of Larry W. Jarrett and Patricia M. Jarrett, and subject to any outstanding ad valorem real property taxes (including taxes which are a lien, but not yet due and payable), any matter which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Security Deed first set out above.
