gpn14 HS Foreclosures STATE OF GEORGIA LIBERTY COUNTY NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Deed to Secure Debt from The Waters Group, LLC and Dennis A. Waters, Jr. to The Heritage Bank dated July 13, 2006 recorded in Deed Book 1402, Page 612, Liberty County, Georgia, Records, rerecorded in Deed Book 1407, Page 415, as modified, renewed, restated or otherwise amended from time to time, including without limitation by that Security Deed dated April 30, 2012 and recorded in Deed Book 1723, Page 599, Liberty County, Georgia, Records. Said Deeds to Secure Debt having been given to secure a Note dated April 30, 2012, in the original principal sum of ONE MILLION FOUR HUNDRED THIRTY EIGHT THOUSAND EIGHT HUNDRED SEVENTY THREE and 99/100'ths DOLLARS ($1,438,873.99), with interest from said date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Liberty County, Georgia, within the legal hours of sale on the first Tuesday in December, 2015, the property described on Exhibit "A" attached hereto and incorporated herein by reference. Exhibit A: All that certain lot, tract or parcel of land situate, lying and being in the 1458th G.M. District of Liberty County, Georgia, being in the City of Hinesville, containing 3.015 acres, more or less, as shown and represented on that certain plat of survey made and prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, bearing a survey date of June 17, 1999, and recorded in Plat Book L-99, Page 2, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northerly by lands of John P. Johnson; Easterly by the right of way of U.S. Highway 84; Southerly by the right of way of Macarthur Drive; and Westerly by lands of Thelma Durden, lands of Paul Leachman, and lands of Harry Preister, all as shown on the above referred to plat of survey. LESS AND EXCEPT that certain tract or parcel of land situate and being in the City of Hinesville, Liberty County, Georgia, more particularly described as follows: Commencing at the intersection Right of Way of U.S. Highway 84 and Macarthur Drive at a concrete monument, said point being the beginning. From the point of beginning, proceed N71'52'28" W a distance of 164.16' to an iron pin set, thence N75'40'53" W a distance of 86.97' to an iron pin set, thence N89'07'06" W a distance 23.86' to an iron pin set, thence N23'36'48" E a distance of 185.38' to an iron pin set; thence S16'55'38" W a distance of 148.10' to a concrete monument, said point being the point of beginning. Said tract contains 0.976 acres, more or less. This is the same property as conveyed in that certain Warranty Deed from P & H Enterprises, Inc. to BRG Hinesville, LLC, dated October 19, 2005 and recorded in Deed Book 1342, Pages 70-72, in the Office of the Clerk of Superior Court of Liberty County, Georgia. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
