Notice of Sale Notice of Sale Under Power in Security Deed Georgia, Jackson County Under and by virtue of the Power of Sale contained in the Deed to Secure Debt and Security Agreement (Security Deed) from Ray T. Gailey to First Reliance Federal Credit Union, dated January 31, 2008, recorded in Deed Book 51X, Pages 47-52, in the Office of the Clerk of the Superior Court of Jackson County, Georgia, as modified by Agreement dated August 20, 2009, recorded in Deed Book 55Y, Pages 780-781, said records, given to secure a Note dated August 20, 2009 in the original principal amount of Ninety Thousand and no/100 Dollars ($90,000.00), with interest thereon from said date at the rate as stated in said Note on the unpaid balance until paid, there will be sold at public outcry to the highest and best bidder for cash before the Courthouse door of Jackson County, Georgia, within the legal hours of sale on the first Tuesday in December, 2015, being December 1, 2015, the following described property: All that tract or parcel of land situate, lying and being in the 257th District, G.M., Jackson County, Georgia, and being shown as Tract 4 - 10.99 acres, on a plat entitled “Boundary Survey for Birdie Lee Garrett”, dated July 17, 1991, by Venable & Associates, Allen L. Venable, GRLS #1761, recorded in Plat Book 35, Page 79, in the Office of the Clerk of the Superior Court of Jackson County, Georgia, said plat being incorporated herein by reference thereto. Together with and subject to a twenty foot easement for ingress and egress from Apple Valley Road as shown on said plat. Said easement running along the northwesterly side of the southeasterly boundary of Tract 1 as the same as shown on the plat from Apple Valley Road to the most southern point of the above described Tract 4. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, and any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, Ray T. Gailey a/k/a Raymond Travis Gailey is in possession of said property. Although not required under Georgia law because the property was not and is not used as a dwelling place by the debtor, notice of this sale has been given to the debtor by certified mail, return receipt requested, more than 30 days prior to the date of the sale.
