STATE OF GEORGIA COUNTY OF HART NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from PEYTON BROOKE KING to UNITED COMMUNITY BANK, dated February 14, 2008, recorded March 5, 2008, in Deed Book 608, Page 62, Hart County, Georgia records, as last modified by Modification of Security Deed dated May 30, 2014, recorded in Deed Book 755, Page 14, Hart County, Georgia records; also that certain Assignment of Rents dated May 20, 2011, recorded in Deed Book 682, Page 258, Hart County, Georgia records, said Security Deed being given to secure a Note from PEYTON BROOKE KING dated May 30, 2014, in the original principal amount of Thirty Eight Thousand Seven Hundred Seventy Six and 05/100 ($38,776.05) Dollars, with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Hart County, Georgia, within the legal hours of sale on the first Tuesday in December, 2015, the following described property: All that tract or parcel of land, together with all improvements thereon, situate, lying and being in the 1116th District, G.M., Hart County, Georgia, being bounded now or formerly on the Southwest by Right of Way of County Road Number 75; on the Northwest by Lot 3, on the Northeast by Lot 16 and on the Southeast by Lot 1, designated as Lot 2, containing 1.002 acres, more or less, as shown by plat and survey entitled "Survey for: Roger Heaton", prepared by Bauknight & Associates, Inc., certified by W. Slate Bauknight, GRLS No. 2534, dated February 2, 2000 and recorded in Plat Book 2-G, Page 256, Hart County, Georgia records; which plat and the recording thereof are hereby incorporated herein by reference for a more detailed description of the property. Together with a 2001 Dynasty 24 x 72 Doublewide Manufactured Home. Manufacturer's Serial Number H801562GL&R. LESS AND EXCEPT: Right of way for public roads and public utilities and the rights of third parties to utilize the Ingress-Egress Easement along the centerline of the Northwesterly property line. Said Easement encroaches 20 feet in width upon the subject property. Subject to all zoning ordinances, easements, rights of way for public roads and public utilities and any restrictions of record affecting said described property as recorded in Deed Book 133, Pages 584-586; Deed Book 162, Pages 456-458; Deed Book 249, Page 577; Deed Book 341, Page 567; Deed Book 351, Pages 65-66 and Deed Book 364, Pages 764-765, Hart County, Georgia records. Said property known as 195 Kotal Road, Canon, according to the present system of numbering houses in Hart County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
