Promissory Note in favor of Lender by assignment dated June 14, 2000 in the original amount of $66,000.00 (hereafter the Note)
Maturity Date of Note: June 25, 2015
Encumbered Property: 1726 Belle Ct., SW, Lilburn, Gwinnett Co., Georgia 30047
Deed to Secure Debt in favor of Lender (by assignment) dated June 14, 2000 recorded in Deed Book 20822, Page 108, Gwinnett Co., GA Records (the Security Deed)
Prior Liens: Security deed in favor of Washington Mutual Bank (and/or its successors or assigns) recorded in Deed Book 16614, Page 200, as modified at Deed Book 42333, Page 96, aforesaid Records.
Foreclosure Date: Tuesday, December 1, 2015 being the first Tuesday in said calendar month.
Place of Foreclosure: Before the courthouse doors in Gwinnett Co., GA
Under and by virtue of the Power of Sale contained in the above described Deed to Secure Debt (hereinafter the Security Deed) executed by the above referenced Grantor to and in favor of the above referenced Lender by assignment (hereinafter referred to as the Grantee), the undersigned will sell at public outcry to the highest bidder for cash at the Place of Foreclosure during the legal hours of sale on the Foreclosure Date, the following described real property (hereinafter referred to as the Encumbered Property):
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING INLAND LOT 75 OF THE 6TH DISTRICT, GWINNETT COUNTY, GEORGIA AND BEING LOT 19, BLOCK A, THE SCARLETT WOODS SUBDIVISION, UNIT NO. 1, AS PER PLAT RECORDED IN PLAT BOOK 4, PAGE 261A, GWINNETT COUNTY RECORDS, WHICH PLAT IS INCORPORATED HEREIN AND MADE A PART HEREOF BY REFERENCE.
The individual and entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the Borrower is: Matthew Kelley with RTED Irvine, LLC, whose address is P.O. Box 18528, Irvine, CA 92623 and whose telephone number is: 800-201-1622 x42.
To the best knowledge and belief of the undersigned, the Encumbered Property is presently in the possession of the Grantor or Grantors successors and/or assigns.
The Note having matured but being unpaid, and in accordance with the provisions of the Security Deed, the undersigned has demanded payment in full, and the above referenced foreclosure sale will be made for the purpose of paying the Note, and the sale will be made for the purpose of paying same; said Encumbered Property will be sold to the highest bidder for cash, the proceeds to be applied to the lawful expenses of the sale and attorneys fees, and then to the payment of the then outstanding indebtedness with interest, all as provided in the Security Deed. Any balance will be distributed as provided by law. The sale will be subject to all unpaid ad valorem taxes or assessments (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, and any liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record which are superior in title to the Security Deed, including, but not limited to, any of the Prior Liens described above.
