NOTICE OF SALE UNDER POWER GEORGIA, COLUMBIA COUNTY By virtue of the Power of Sale contained in that certain Security Deed given from Kristen B. Harkelli to Mortgage Electronic Registration Systems, Inc. ("MERS") as nominee for Georgia Bank & Trust Company of Augusta, dated 07/14/2006, recorded 07/17/2006 in Deed Book 5531, Page 177, Columbia County, Georgia records, and as modified in Deed Book 7854, Page 123, Columbia County, Georgia records, and as last assigned to Branch Banking and Trust Company by virtue of assignment recorded in Deed Book 9923, Page 156, Columbia County, Georgia records, said Security Deed having been given to secure a Note of even date in the principal amount of ONE HUNDRED THIRTY-SIX THOUSAND TEN AND 00/100 DOLLARS ($136,010.00), with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Columbia County, Georgia, within the legal hours of sale on the first Tuesday in December 2015 by Branch Banking and Trust Company, as Attorney in Fact for Kristen B. Harkelli, all property described in said Security Deed including but not limited to the following described property: ALL THAT LOT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF COLUMBIA, BEING KNOWN AND DESIGNATED AS LOT 9, THE HIGHLANDS AT IVY FALLS PLANTATION, PHASE I, AS SHOWN ON A PLAT RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF COLUMBIA COUNTY, GEORGIA IN PC-D, SLIDE 177 #7. REFERENCE IS HEREBY MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND LOCATION OF SAID PROPERTY. SAID PROPERTY IS CONVEYED SUBJECT TO PROTECTIVE COVENANTS RECORDED IN SAID CLERK`S OFFICE IN DEED BOOK 3192, PAGES 245-255, AS AMENDED BY INSTRUMENT DATED SEPTEMBER 5, 2002 AND RECORDED IN SAID CLERK`S OFFICE IN DEED BOOK 3218, PAGE 249-251. Said property being known as 1856 LONG CREEK FALLS , GROVETOWN, GEORGIA 30813 according to the present numbering system in Columbia County. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the title to said property: any superior Security Deeds of record; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; any outstanding taxes, including but not limited to ad valorem taxes, which constitute liens upon said property; special assessments; all outstanding bills for public utilities which constitute liens upon said property; all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed.
