Chattooga County, Georgia, having filed its application to acquire by condemnation title to the following:
All that tract or parcel of land lying and being in Land Lot 22 in the 6th District and 4th Section of Chattooga County, Georgia, and being part of Lots Five (5), Six (6), Seven (7) and Eight (8) in Block (10( of the City of Summerville according to a plat recorded in Plat Book 1, Page 4, and as resurveyed by Carl N. Morrison & Associates, Inc., by survey dated January 27, 1992, and being more particularly described as follows:
Beginning at an iron pin on the west right-of-way of North Commerce Street, said pin being 159.78 feet north as measured along said right-of-way from its intersection with the north right-of-way of West Washington Street; thence north 69 52' 14" west 121.55 feet to a point; thence south 20 0' 0" west 28.28 feet to an iron pin; thence north 70 0' 0" west 20 feet to an iron pin; thence north 20 0' 0" east 60 feet to an iron pin; thence north 70 0' 0" west 2.5 feet to an iron pin; thence north 14 0' 0" east 24 feet, more or less, to a point; thence south 70 0' 0" east 142.37 feet along the center of a building line to the west right-of-way of North Commerce Street; thence south 19 43' 18" west 60.29 feet to the point of beginning.
Together with an old theater building located thereon and being that property designated as Map 27, Parcel 24, according to records as presently maintained by the Chattooga County Tax/Property Assessors.
Subject to an easement for ingress and egress and maintenance of a certain set of stairs for access to the building located immediately north of the aforementioned tract. Said access shall include the right to construct, reconstruct, repair and improve the existing stairway in the northeast corner of said tract herein described and shall be for the width of the existing stairs only. Said easement shall be limited to ingress and egress for the upstairs of the building located north of the aforementioned tract and to provide a means of access. This easement shall remain for the life of both buildings.
Now, therefore, you and each of you are required to be and appear before the presiding, Judge of the Superior Court, in the courthouse in Chattooga County, Georgia, on the 2ndday of November, 2015, at 9 oclock A.M. to make known your objections, if any, your title and interest and the value thereof, to select an assessor and show cause, if any, why the prayers of the Petitioner should not be granted.
