Notice of Sale Under Power. State of Georgia, County of Chattooga. Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by a records, as last assigned to JPMorgan Chase Bank, National Association (the Secured Charles L Burrage Jr And Kelly K Burrage To JPMorgan Chase Bank, N.A. , dated 01/14/2005, and Recorded on 01/24/2005 as Book No. 468 and Page No. 200, Chattooga County, Georgireditor), by assignment, conveying the afterdescribed property to secure a Note of even date in the original principal amount of $77,647.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the Chattooga County Courthouse within the legal hours of sale on the first Tuesday in December, 2015, the following described property: All that tract or parcel of land lying and being in Land Lot 229 of the 14th District, 4th Section, Chattooga County, Georgia, and being more particularly described as follows:
Beginning at an iron pin located on the easterly right of way line of Holland & Chattoogaville Road (80 foot right of way) 1291 feet northerly, as measured along the easterly right of way line of Holland & Chattoogaville Road from a point formed by the intersection of the easterly right of way line of Holland & Chattoogaville Road and the south land lot line of Land Lot 229; running thence north 04 degrees 09 minutes 55 seconds east along the easterly right of way line of Holland & Chattoogaville Road 293.00 feet to an iron pin; running thence north 88 degrees 30 minutes 00 seconds east 193.50 feet to an iron pin; running thence south 00 degrees 31 minutes 57 seconds east 291.61 feet to an iron pin; running thence south 88 degrees 30 minutes 00 seconds west 217.50 feet to an iron pin located in the easterly right of way line of Holland & Chattoogaville Road and the point of beginning.
The above described property is more particularly shown as a 1.38 acre tract on, and delineated according to, that certain plat of survey for Jannie A. Montegomery Carter by Perimeter Surveying Company, Inc. Kenneth l. Nutt, G.R.L.S. 2104, dated 08/05/96, which said that the plat is incorporated herein by this reference thereto for a more complete description of the courses and distance, metes and bounds of the lands described herein.
The above description is the same as found in prior deed of record as a boundary line survey was not done at the time of this conveyance.
Being the same property conveyed to Charles L. Burrage, Jr. from Federal National Mortgage Association by special warranty deed dated June 3, 1998 and recorded June 11, 1998 in book 320, page 457 in the Clerk of Superior Courts Office for Chattooga County, Georgia.
This conveyance is subject to all restrictions, easements, setbacklines, and other conditions shown of record in the Clerk of Superior Court's Office for Chattooga County, Georgia. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). JPMorgan Chase Bank, National Association holds the duly endorsed Note and is the current assignee of the Security Deed to the property. JPMorgan Chase Bank, National Association, acting on behalf of and, as necessary, in consultation with JPMorgan Chase Bank, National Association (the current investor on the loan), is the entity with the full authority to negotiate, amend, and modify all terms of the loan. Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the security deed. Pursuant to O.C.G.A. Section 913172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.
