NOTICE OF FORECLOSURE OF RIGHT TO REDEEM
[REF. O.C.G.A., Section 48-4-5 et seq.; 48-4-45 & 48-4-46]
TO: SHIRLEY, PEGGY ESTATE AND HEIRS KNOWN AND UNKNOWN OF, OCCUPANT OF 238 COUNTRY LA NE, TIGER, GEORGIA 30576 AND ALL PERSONS KNOWN AND UNKNOWN HAVING OF RECORD IN RABUN COUNTY, GEORGIA , ANY RIGHT, TITLE INTEREST IN, OR LIEN UPON 238 COUNTRY LANE, TIGER, GEORGIA 30576
RE: FORECLOSURE OF EQUITY OF
REDEMPTION FOR TAX SALE DEED (REF. 0.C.G.A. 48-4-45, 46).
Take notice that: The right to redeem the following described property, to wit: [All that tract or parcel of land lying and being in Land Lot 25, of the 5th Land District, Rabun County, Georgia and being 0.55 acres, more or less, as more particularly described according to that certain plat of survey dated February 23, 1996, revised May 16, 1996, prepared by William F. Rolader, GRLS No. 2042, said plat being recorded in Plat Book 37, Page 227, of the Rabun County Plat Records. Said plat and the record of the same being incorporated herein by reference for a more full and complete description of the property herein conveyed. ALSO CONVEYED, is a perpetual, non-exclusive easement for ingress and egress over and across that certain 15-foot wide public road and that certain (10) foot wide gravel drive depicted as Rogers driveway on the above referenced plat for access to Old U.S. 441 and said property is conveyed subject to the rights of others to use said roadways as may lie within the boundary line of said property. Said property lying in said road right-of-way may also be utilized for the installation of utility lines. The above described property is conveyed subject to a reservation for an easement to an adjoining tract, said easement shown on the above referenced plat.
TO HAVE AND TO HOLD the said tract or parcel of land, with all and the singular the rights, members and appurtenances thereof, to the same being, belonging, or in anywise appertaining, to the only proper use, benefit and behoof of the said party of the second part, their heirs and assigns forever in FEE SIMPLE.
As described in Deed Book X22, Page 168. Further described as Map and Parcel 044C085D] will expire and be forever foreclosed and barred as of five o'clock (5 p.m.) on and after November 29th , 2015 or 45 days after service of this Foreclosure Notice in accordance with Georgia law. The tax deed to which this notice relates is dated October 29, 2014 and recorded in the Office of the Clerk of the Superior Court of Rabun County, Georgia in Deed Book J41, Pages 144-145. The property may be redeemed on or before the November 29, 2015 or 45 days after being served with this Foreclosure Notice, by payment of the redemption price as fixed and provided by law to the undersigned at the following address:
