NOTICE OF SALE UNDER POWER
GEORGIA, RABUN COUNTY
Under and by virtue of the Power of Sale contained in a Security Deed from CLIFTON LAFEVERS to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR EQUITY SERVICES, INC., dated JULY 11, 2003, and recorded on JULY 16, 2003, in DEED BOOK Q24, PAGE 638, of the RABUN County, Georgia Records; as last assigned to GREEN TREE SERVICING LLC NKA DITECH FINANCIAL LLC, by Corrected Assignment dated SEPTEMBER 9, 2015, and recorded on OCTOBER 15, 2015, recorded at DEED BOOK I42, PAGE 415, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of TWO HUNDRED THIRTY TWO THOUSAND Dollars and 00/100 ($232,000.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of RABUN County, Georgia, within the legal hours of sale on the first TUESDAY in DECEMBER 2015, the following described property:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 2 AND 3 OF THE 5TH LAND DISTRICT OF RABUN COUNTY, GEORGIA, BEING IDENTIFIED AS LOT 2 OF DEERFIELD, CONSISTING OF 1.21 ACRES, MORE OR LESS, AS SHOWN ON A PLAT OF SURVEY PREPARED BY T. LAMAR EDWARDS, RLS, UNDER DATE OF JULY 13, 1993 AND BEING RECORDED AMONG RABUN COUNTY RECORDS IN PLAT BOOK 34, PAGE 227, SAID PLAT IS INCORPORATED HEREIN BY REFERENCE FOR A MORE COMPLETE DESCRIPTION. ALSO, A PERPETUAL, NON-EXCLUSIVE ROAD RIGHT OF WAY EASEMENT OVER AND ACROSS DEERFIELD DRIVE TO SEED TICK ROAD, A PUBLIC ROAD.
PROPERTY IS CONVEYED SUBJECT TO RESTRICTIONS AS RECORDED IN DEED BOOK X14, PAGE 640, RABUN COUNTY, GEORGIA RECORDS.
The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorneys fees having been given) and all other payments provided for under the terms of the Security Deed and Note.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ditech Financial LLC fka Green Tree Servicing LLC, 1400 Turbine Drive, Suite 200, Fort Worth, TX 57703, (800) 643-0202.
