POWER IN SECURITY DEED

Under and by virtue of the power of sale contained in a Deed to Secure Debt given by B. SUZANNE WELCH to RABUN COUNTY BANK dated June 23, 2006 and recorded in Deed Book H-30, Pages 12-15, Rabun County, Georgia Records, conveying the after described property to secure a note dated December 16, 2013 in the original principal amount of TWO HUNDRED FORTY-THREE THOUSAND FOUR HUNDRED SIXTY-SEVEN AND 30/100 DOLLARS ($243,467.30), with interest thereon as set forth therein, there will be sold by the undersigned at public outcry to the highest bidder, for cash, before the courthouse door of Rabun County, Georgia, within the legal hours of sale on the first Tuesday in December, 2015, the same being December 1, 2015, the following described property:
All that tract or parcel of land lying and being in Land Lot 21 of the Second Land District of Rabun County, Georgia, and being in the City of Clayton, Georgia and being more fully described as follows: To find the point and place of BEGINNING, commence at the intersection of the centerline of Chechero Street with the centerline of Savannah Street and run South 00 degrees 02 minutes West 173.4 feet to an iron pin at the intersection of Chechero Street and Earl Circle; thence along and with the southerly right-of-way line of Earl Circle South 86 degrees 02 minutes East 221.5 feet to an iron pin; thence leaving Earl Circle South 01 degrees 19 minutes East 108.7 feet to a point; thence North 89 degrees 09 minutes West 120.3 feet to an iron pin; thence North 89 degrees 08 minutes West 116.7 feet to an iron pin; thence North 06 degrees 26 minutes East 121.2 feet to an iron pin and the point and place of beginning, containing 0.60 acre and being more fully described upon a plat of survey prepared by T. Lamar Edwards, GRLS No. 1837, dated September 9, 1988 and recorded in Plat Book 25, Page 280 of the Rabun County plat records. Said plat and the record of the same being incorporated herein by reference.
There is excepted and excluded from the above described lands:
All that tract or parcel of land lying and being in Land Lot 21 of the Second Land District of Rabun County, Georgia consisting of 0.19 acre and being the same lands described upon a plat of survey dated June 24, 1993, prepared by William F. Rolader, GRLS No. 2042, said survey being recorded in Plat Book 34, Page 297 of the Rabun County, Georgia plat records. Said survey is incorporated herein by reference for a full and complete description of the lands excluded from the above 0.60 acre tract.
There is excepted and excluded from the above-described property, public utility and right-of-way easements of record and those in use.
The debt secured by said deed to secure debt has been and is hereby declared due because of, among other possible events of default, the failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which may be disclosed by a current accurate survey and inspection of the property, any easements, assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt first set out above. The entity that has full authority to negotiate, amend and modify all terms of the Deed to Secure Debt with the Debtor is: RABUN COUNTY BANK located at 121 Rickman Street, Clayton, Georgia 30525, 706-782-4571. The secured Creditor is not required by law to negotiate, amend or modify the terms of the Deed to Secure Debt.
To the best knowledge and belief of the undersigned the party in possession of the property is B. SUZANNE WELCH and/or any tenant or tenants in possession and said property is located at 43 Chechero Street, Clayton, Georgia 30525 and is designated as being Rabun County Tax Parcel #C014-024 .
The sale will be conducted subject to: (1.) confirmation that the sale is not prohibited under the U. S. Bankruptcy Code; and (2.) final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
