Under Power
Georgia, Pike County:
By virtue of the power and authority contained in a Security Deed and under the power of sale contained therein, executed by James F. Anderson, Sr. to First Bank Of Pike, dated March 4, 2011, which is recorded in the Clerk's Office, Superior Court of Pike County, Georgia, in Deed Book 853, Page 275; said Georgia Security Deed and Security Agreement having been given to secure a Promissory Note dated May 24, 2013, with interest from date at the rate stated in said Promissory Note on the unpaid balance until paid, the undersigned will sell at public outcry to the highest bidder for cash at the courthouse in Zebulon, Pike County, Georgia, between the legal hours of sale on the first Tuesday in December, 2015 to-wit: December 1, 2015, the following real estate:
All that lot, tract or parcel of land, together with all improvements located thereon, presently known as 201 Brookstone Way, situate, lying and being in Land Lot No. 62 of the 2nd Land District of Pike County, Georgia, and being more particularly shown and designated as LOT 6, containing 2.03 acres, on a plat of survey entitled, “Final Plat Of: Brookstone,†prepared by Steve J. Reeves, Registered Land Surveyor No. 2765, dated November 20, 2003, a copy of which said plat is recorded in Plat Book 21, Page 196, of the Superior Court records of Pike County, Georgia, and which said plat, together with metes, bounds, and courses and distances shown thereon with respect to Lot 6, is incorporated herein and made a part hereof as fully as if set out herein.
The debt secured by said Security Deed and note has been and is hereby declared due and payable in full because of nonpayment of indebtedness secured thereby pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with the legal requirements of the Deed to Secure Debt and Note(s).
The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including attorney's fees, and the remainder, if any, shall be applied as provided by law.
To the best of the undersigned's knowledge and belief, the property is in the possession of and will be sold as the property of James F. Anderson, Sr. with a mailing address known as 201 Brookstone Way, Zebulon GA 30295/P.O. Box 94, Concord, GA 30206.
The sale will be conducted subject: 1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and, 2) to final confirmation and audit of the status of the loan with the holder of the Georgia Security Deed and Security Agreement.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which may be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, easements and matters of record in superior to the Georgia Security Deed and Security Agreement in favor of First Bank Of Pike, dated March 4, 2011, which is recorded in the Clerk's Office, Superior Court of Pike County, Georgia, in Deed Book 853, Page 275.
