Georgia, Jackson County
Under and by virtue of the power of sale contained in that Purchase Money Security Deed from Jeffrey D. Straub and Mary Martin to Cameron D. Boswell dated October 22, 2014, recorded October 23, 2014, in Deed Book 69K, Pages 650-657, in the Jackson County, Georgia Deed Records, the undersigned will sell at public outcry to the highest bidder for cash before the courthouse door in Jackson County, Georgia during the legal hours of sale, on the first Tuesday in December, 2015 by Cameron D. Boswell as Attorney-in-Fact for Jeffrey D. Straub and Mary Martin the following described property:
All that tract or parcel of land, together with improvements thereon, lying and being in the 255th District, G.M., Jackson County, Georgia, designated as Lot No. 11 of the subdivision of Charles Waters property as shown on plat of survey made by E. M. Smith, Surveyor, dated July 11, 1966, for auction by J. L. Todd Auction Company, which said plat is recorded in Jackson County Records, and more particularly described according to said plat as follows:
Beginning at a stake marking the northeast most corner of said property where it corners with property of Hardman and Faulkner, thence south 25 west along Hardman property line 170 feet, more or less, to a stake, thence north 65-15 west 250 feet, more or less, to stake on the eastern border of Hospital Road, thence along the said border of said road, north 24-45 east 100 feet, more or less, to a stake on Faulkner property line, thence along Faulkner property line south 80-45 east 260.3 feet more or less, to the point of beginning.
For plat see Plat Book 5, page 164. For a more detailed description of said tract, reference is hereby made to said plat as recorded.
This being the same property described in the Warranty Deed between Cameron D. Boswell as Grantor and Jeffrey D. Straub and Mary Martin as Grantees, dated October 22, 2014, and recorded in Deed Book 69K, pages 647-648, Jackson County, Georgia Deed Records.
The property has an address of 652 Hospital Road, Commerce, Georgia 30529.
The indebtedness secured by said Purchase Money Security Deed being in default for failure to pay said indebtedness as agreed, among other possible events of default, this sale will be made for the purposes of paying the indebtedness and all expenses of sale, including attorney's fees (notice having been given as provided by law).
The property will be sold subject to the following:
(1) all prior restrictive covenants, easements, rights-of-way or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; (4) the outstanding ad valorem taxes and assessments, if any; (5) unpaid water and sewage bills, that constitute liens against the property, whether due and payable or not yet due and payable; and (6) matters of record superior to the Purchase Money Security Deed first set out above.
To the best of the undersigned's knowledge and belief, the party in possession is Jeffrey D. Straub and Mary Martin, or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Purchase Money Security Deed.
