STATE OF GEORGIA COUNTY OF GLYNN NOTICE OF SALE UNDER POWER Because of a default in the payment of the indebtedness secured by that certain Security Deed, dated November 18, 2005, executed by Valarie L. Clark and Eugene B. Clark to Mortgage Electronic Registration Systems, Inc. as nominee for Countrywide Home Loans, Inc., recorded in Deed Book 1835, Page 467, Glynn County, Georgia Deed Records, and securing a Note in the original principal amount of $212,000.00, said Security Deed last having been assigned to DITECH FINANCIAL LLC F/K/A GREEN TREE SERVICING LLC, the current holder thereof, has declared the entire amount of said indebtedness evidenced by the Note immediately due and payable and, pursuant to the power of sale contained in said Security Deed, will, on the first Tuesday in November, 2015 to-wit: November 3, 2015, during the legal hours of sale, before the Glynn County Courthouse door, sell at public outcry to the highest bidder for cash, the following described real property: All that tract or parcel of land lying and being on St. Simons Island, Glynn County, Georgia, described and identified according to that certain site plan of Lincoln Place Condominiums prepared by Robert W. Williams, Registered Architect No. 5017, dated April 4, 1984, and being recorded in Condominium Book 4, Page 727; and, being recorded in Condominium Book 4, Page 898; and, those certain location plat recorded by James L. Coninc, GRLS No. 1005, dated April 4, 1984, recorded in Plat Drawer 19, Plat Number 1005, revised at Condominium Plat Drawer 19, Plat Number 1084, Glynn County, Georgia Records; as ALL OF UNIT NUMBER F-3, LINCOLN PLACE CONDOMNTUMS, GLYNN COUNTY, GEORGIA. This Unit is part of the property described in the Declaration of Condominium for Lincoln Place Condominium, dated October 10, 1984, recorded in Deed Book 25-M, Page 1, et seq., Glynn County, Georgia Records. Said Declaration, Plan, and Plat are incorporated herein and made a part hereof by reference. The aforedescribed real property is also known as 104 Lincoln Pl, Unit F3, St. Simons Island, GA 31522, according to the present system of numbering houses in Glynn County, Georgia. This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit as to the amount and status of the loan with the holder of the Security Deed, including but not limited to, a determination that the borrower has not reinstated the loan prior to the foreclosure sale.
