NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of the power of sale contained in a Security Deed from Karsean Roberts to Mortgage Electronic Registration Systems Inc., as nominee for Taylor, Bean & Whitaker Mortgage Corp., its successors and assigns dated May 15, 2009 recorded in Deed Book 01217, Page 1081 , Richmond County Records, and last assigned to Carrington Mortgage Services, LLC, conveying the after-described property to secure a Note in the original principal amount of NINETY-FOUR THOUSAND ONE HUNDRED SIXTY-TWO AND 00/100 ($94,162.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash, before the Courthouse door of Richmond County, Georgia, during the legal hours of sale on Tuesday, November 3, 2015 the following described property, to wit: ALL THAT LOT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF RICHMOND, AND BEING KNOWN AND DESIGNATED AS LOT 23, BLOCK "A", SECTION THREE OF NORTHVIEW SUBDIVISION, AS MORE PARTICULARLY SHOWN ON PLAT THEREOF WHICH IS RECORDED IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF RICHMOND COUNTY,GEORGIA, REALTY REEL 264, PAGES 1554-1559, TO WHICH PLAT REFERENCE IS HEREBY MADE FOR THE PURPOSE OF PROVIDING A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO THE METES, BOUNDS, COURSES, DISTANCES AND LOCATION OF SAID PROPERTY. THIS CONVEYANCE IS MADE SUBJCT TO ANY ENFORCEBLE RESTRICTIONS AND/OR EASEMENTS OF RECORD IN SAID CLERK'S OFFICE WHICH MIGHT BE APPLICABLE TO SAID PROPERTY. THIS IS THE SAME PROPERTY CONVEYED ON 11-9-98 TO PETER TOPKEN, TRUSTEE OF 1846 SOUTH BARTON DRIVE TRUST RECORDED AT BOOK 624 PAGE 15. APN: 145-0-128 The Debt secured by said Security Deed has been and is hereby declared due because of nonpayment of the indebtedness when due and in the manner provided in the Note and Security Deed. The debt remaining in default, the sale will be made for the purpose of paying the same and all expenses of sale, as provided in the Security Deed and by law, including attorney's fees, notice of intent to collect attorney's fees having been given. Said property will be sold subject to any outstanding ad valorem taxes, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Karsean Roberts aka Karseen Roberts or, a tenant or tenants, and said property was or is commonly known as 1846 South Barton Drive, Augusta, GA 30906. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
