NOTICE OF FORECLOSURE SALE UNDER POWER RICHMOND COUNTY, GEORGIA THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Sharon Alexander to First Choice Mortgage, Inc., dated March 4, 2002, and recorded in Deed Book 00778, Page 0017, Richmond County, Georgia Records, subsequently modified by a Loan Modification Agreement recorded May 27, 2014 in Book 1440, Page 1612 in the amount of Ninety-One Thousand Two Hundred Sixty-Three and 60/100 ($91,263.60) Richmond County, Georgia Records, as last transferred to SunTrust Mortgage, Inc. by assignment recorded on March 5, 2002 in Book 00778 Page 0026 in the Office of the Clerk of Superior Court of Richmond County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Seventy-Nine Thousand Seven Hundred Forty-Eight and 0/100 dollars ($79,748.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, within the legal hours of sale on November 3, 2015, the following described property: ALL that lot or parcel of land, together with improvements thereon, situate, lying and being in Augusta- Richmond County, Georgia, being known and designated as the remainder of Lot 15, Block G of Brookwood Subdivision, Section IV, as shown on a plat thereof which is filed for record in the Office of the Clerk of the Superior Court for Richmond County, Georgia in Realty Book 33-H, pages 822-823. Reference is hereby made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. This property is conveyed subject to Protective Covenants applicable to said subdivision which are recorded in the aforesaid Clerk's Office in Realty Book 31-G, pages 801- 806. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Sharon Alexander or tenant(s); and said property is more commonly known as 2328 Sumac Drive, Augusta, GA 30906. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
