TO: Jeff Eller, 3028 Hwy 76 West, Clayton, GA 30525; Wells Fargo Bank, National Association, As Trustee of the CF Southeast Trust 2011-1, c/o AMRESCO Commercial Finance, LLC, 412 Park Center Boulevard, Suite 300, Boise, Idaho 83706, and all persons claiming adversely to the title of Petitioners herein and All the World.
Notice is given that PFS Group, LLC has commenced an action to quiet title to a parcel of real property owned by Petitioner and in which you may claim an interest. The relief sought is to establish Petitioners title in the land described herein, removing any and all clouds to the title of Petitioner thereto, that Petitioner's title be adjudicated by this court to be superior in dignity to the right, title and interest of the Respondents, and each of them, and all the world, and that said right, title and interest of Respondents and each of them, and all the world, be adjudicated by this court to be subject, subordinate, and inferior to the rights of the Petitioners.
The date upon which this action is filed is September 28, 2015. The date for the Order for Service of Publication is September 28, 2015.
The parcel of real property which Petitioner seeks to quite title is:
All that tract or parcel of land lying and being in Land Lot 25, 4th District, Rabun County, Georgia, being all of Lot No. 122, Block KK, of Kingwood Estates and consisting of 0.96 acres, more or less, as shown on that plat of the survey prepared by William F. Rolader, Georgia Registered Land Surveyor No. 2042, dated October 22, 2004 and recorded in Plat Book 53, Page 158, Clerk's Office, Rabun County Superior Court. Reference is hereby made to said plat of survey for the purpose of incorporating same herein for a full and complete description of the property herein conveyed.
Conveyed herewith is a perpetual, non-exclusive easement for access ingress and egress over and across the subdivision roads to and from the above-referenced tract of land to the public road system.
The property herein is subject to a twenty foot (20') easement reserved about all property lines for future sewer, storm drainage, utility and/or cart path use, maintenance and repair.
This property is subject to the covenants and restrictions for Kingwood Subdivision recorded in Deed Book E-18, Pages 487-505 and Deed Book L-18, pages 98-148 and all modifications and amendments or record use or of record.
This property is conveyed subject to all easements for roads and utilities in use or of record.
You are hereby summoned and required to file with the Clerk of said Court and serve upon the Petitioners' Attorney, whose name and address is: Albert O. English, 17 Chechero Street, Clayton, Georgia 30525 and answer to the Petition in this cause within thirty (30) days after the date of said Order of Service by Publication. If you fail to do so, judgment by default will be taken against you for the relief demanded in the Petition.
