STATE OF GEORGIA LONG COUNTY NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Deed to Secure Debt from Southeastern Commercial Contractors, Inc. to The Heritage dated May 26, 2005, 2005, recorded in Deed Book 246, Page 424, Long County Records. Said Deed to Secure Debt having been given to secure a Note dated June 26, 2013, in the original principal sum of TWO MILLION TWO HUNDRED THIRTY FIVE THOUSAND ONE HUNDRED FORTY SEVEN and 78/100'ths DOLLARS ($2,235,147.78), with interest from said dates at the rate stated in said Notes on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at LONG County, Georgia, within the legal hours of sale on the first Tuesday in November, 2015, the property described on Exhibit "A" attached hereto and incorporated herein by reference. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. If there are more than one tracts under said deed, each tract will be sold individually. The individual or entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Sherrie Struble, 300 S. Main Street, Hinesville, Georgia, (912) 408-6310. Please understand that the secured creditor is not required to negotiate, amend, or modify the terms of the mortgage instrument. Said property will be sold as the property of Southeastern Commercial Contractors, Inc, subject to the outstanding ad valorem taxes and/or assessments, if any, and all easements and restrictions of record, if any, having priority over this Deed to Secure Debt. District of Long County, Georgia, being more particularly described as Tract 2 (containing 62.72 acres, net 61.32 acres, exclusive of road right of way) as shown and represented on that certain plat of survey made and prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, dated September 24, 2003 and recorded in Plat Book 15, Folio 273, in the Office of the Clerk of Superior Court, Long County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northerly by Tract 1; Easterly by lands of Alton Davis, et al.: Southeasterly by lands of Jerry Wheeler, Terry Wheeler, and Patricia McCullough; Southerly by lands of Jerry Wheeler and by Tract 4; and Northwesterly by lands of Ollie and Sharon Bearden, all as shown on the above referred to plat of survey. All of that certain tract or parcel of land situate, lying and being in the 17th G.M. District of Liberty County, Georgia, and being in the City of Hinesville, being known and designated as Parcel "B", containing 1.085 acres, as shown and represented on that certain plat of survey made and prepared by John O. Parker, Georgia Registered Land Surveyor No. 1850, dated July 16, 1998 and recorded in Plat Section L-83, Page 2, in the Office of the Clerk of Superior Court, Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said parcel of land being bounded, now or formerly, as follows: Northeasterly by the right of way of Frank Cochran Road; Southeasterly by the right of way of Pacific Place; Southwesterly by Willowbrook Subdivision; and Northwesterly by Parcel "A", containing 0.927 of an acre, all as shown and represented on the above referred to plat of survey. Kinard, Jr., Georgia Registered Land Surveyor No. 1572, dated March 10, 1992 and recorded in Deed Book 580, Page 275, in the Office of the Clerk of Superior Court, Liberty County, Georgia, specific reference to which plat is made a part of this description and which plat is incorporated herein by reference for descriptive and all other purposes. Said parcel of land being bounded, now or formerly, as follows: Northerly by a drainage ditch and a private road providing access from South Main Street to the K-Mart Shopping Center; Westerly by the Kroger (formerly Food Max) Shopping Center (Tract "E" on the above described plat); Southerly by the public road providing access from South Main Street to Kroger (formerly Food Max) Shopping Center; and Westerly by the right of way of South Main Street, with a frontage thereon for this property 254.54 feet, more or less, all as more fully shown on the above described plat. Exhibit A: All of that certain tract or parcel of land situate, lying and being in the 1458th G.M. District of Liberty County, Georgia, and being in the City of Hinesville, containing 1.35 acres, more or less, and designated as Parcel "F", as shown and represented on that certain plat of survey made and prepared by Quillie E. Kinard, Jr., Georgia Registered Land Surveyor No. 1572, dated March 10, 1992 and recorded in Deed Book 580, Page 275, in the Office of the Clerk of Superior Court, Liberty County, Georgia, specific reference to which plat is made a part of this description and which plat is incorporated herein by reference for descriptive and all other purposes.
