Parker to American General Financial Services, Inc. dated November 21, 2007, and recorded in Deed Book 985, Page 110, Colquitt County Records, said Security Deed having been last sold, assigned, transferred and conveyed to U.S. BANK NATIONAL ASSOCIATION AS INDENTURE TRUSTEE FOR CSMC TRUST 2014-CIM1 MORTGAGE-BACKED NOTES, SERIES 2014-CIM1 by Assignment, securing a Note in the original principal amount of $32,166.24, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, November 3, 2015, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land lying and being in Land Lot 43 of the 8th Land District of Colquitt County, Georgia, and being more particularly described as follows:Commence at a point where the center line of Bell Road Intersects with the center line of GA State Route 270 (80 foot right of way) and go thence north 53 degrees 33 minutes 54 seconds east along the center line of GA State Route 270 a distance of 367.51 ft to a point; go thence north 36 degrees 26 minutes 06 seconds west 40 ft to a point on the northern right of way of GA State Route 270 and the point of beginning; thence proceed along the northern right of way of said GA State Route 270 north 53 degrees 33 minutes 54 seconds east a distance of 448.36 ft to a point; thence proceed along a curve to the right on a chord bearing north 57 degrees 54 minutes 15 seconds east a chord distance of 174.98 ft and an arc distance of 179.15 ft to a point; thence proceed along a fence line south 89 degrees 31 minutes 00 seconds west a distance of 691.42 ft to a point in the center of Bridge Creek; thence continue along the center line of Bridge Creek the following courses and distances; south 15 degrees 06 minutes 48 seconds east a distance of 85.76 ft; south 34 degrees 00 minutes 06 seconds east a distance of 107.74 ft; south 28 degrees 50 minutes 11 seconds east a distance of 206.98 ft; north 36 degrees 26 minutes 06 seconds west a distance of 40.00 ft to the point of beginning of the lands herein described. The above tract contains 2.800 cres and is more particularly shown on a plat of survey prepared by Malcolm Burnsed, GA Registered, Land Surveyor #1681. dated September 25, 1999 and entitled "Plat Property of Max Parker." and recorded in Plat Book 34, Page 6, Colquitt County Land Records. Said property is known as 792 Hwy 270 W, Doerun, GA 31744, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
