AS NOMINEE FOR TAYLOR, BEAN & WHITAKER MORTGAGE CORP. dated September 15, 2008, filed for record September 17, 2008, and recorded in Deed Book 1020, Page 0039, COLQUITT County, Georgia Records, and as modified by that certain Loan Modification Agreement recorded in Deed Book 1184, Page 480, COLQUITT County, Georgia Records, as last transferred to CARRINGTON MORTGAGE SERVICES, LLC by assignment recorded in Deed Book 1227, Page 551, COLQUITT County, Georgia Records. Said Deed to Secure Debt having been given to secure a Note dated September 15, 2008 in the original principal sum of SEVENTY THREE THOUSAND FOUR HUNDRED THIRTY AND 0/100 DOLLARS ($73,430.00), with interest from date at the rate stated in said Note on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at COLQUITT County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in November, 2015, the following described property: LOT 21 OF QUAIL RUN SUBDIVISION LOCATED IN LAND LOT 294 IN THE 8TH LAND DISTRICT OF COLQUITT COUNTY, GEORGIA, AS SHOWN BY A PLAT OF SAID SUBDIVISION PREPARED BY SOUTHLAND SURVEYING COMPANY DATED DECEMBER 5, 1994, AND RECORDED IN PLAT BOOK 28, PAGE 114, COLQUITT COUNTY RECORDS, WHICH SAID PLAT AND THE RECORD THEREOF ARE BY REFERENCE INCORPORATED HEREIN AND MADE A PART HEREOF. ALSO ONE 1999 27 X 56 HORTON MOBILE HOME SERIAL NUMBER H154391GRL. THIS BEING A PORTION OF THE PROPERTY CONVEYED TO JAMES M. FOUNTAIN, III BY WARRANTY DEED DATED MARCH 24, 2005 AND RECORDED IN DEED BOOK 858, PAGE 546, COLQUITT COUNTY RECORDS. To the best of the knowledge and belief of the undersigned, the party in possession of the property is RAUL LEAL or a tenant or tenants. Said property may more commonly be known as: 150 QUAIL LANE, MOULTRIE, GA 31768. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees (notice of intent to collect attorneys fees having been given).
