NOTICE OF SALE UNDER POWER
By virtue of a lien and a power of sale contained in the Declaration of Covenants, Conditions and Restrictions of Glenn Abby Condominium Association, Inc., as amended, of file and record in Deed Book I-6, Pages 519-564, Pages and in Deed Book M-16, Pages 125-127 in the Office of the Clerk of Rabun County Superior Court, and said Declaration, as amended, providing for the assessment, payment and collection of certain maintenance fees and other charges due said Glenn Abby Condominium Association, Inc. by the following owners with late charges and interest, and said charges to the following being past due and unpaid, demand by certified mail having been made upon them by the said Association, and payment refused, there will be sold by the undersigned at public outcry to the highest bidder, for cash before the Courthouse door in Rabun County, Georgia, within the legal hours of sale on the first Tuesday in October, 2015, the same being October 6, 2015, the following described property of the named owners:
Certain Interval Time Share Unit Weeks and all rights, title and interest pertaining thereto in Glenn Abby Condominium Association, Inc., the same being located in the 2nd Land District, in either Land Lots 169, 170, 195 or 196, Rabun County, Georgia, in the City of Sky Valley, and being improved property as is more fully shown on a plat recorded in Condominium Plat Book 1, Page 252, Rabun County Records, said Interval Time Share Unit Weeks being identified more particularly by owner and week as follows: Philip Neal Clark, Week GAA25, 55 Charles Avenue, Sylva, North Carolina 28779; Robert B. Edwards, Jr., Week GAA19, 3108 South Black Oak Drive, Stillwater, Oklahoma 74074; Leona Fritzius, c/o Suzanne Ireland, Week GAD34, 843 Cotton Bay Drive E., Apt. 2512, West Palm Beach, Florida 33406; Jack S. Gerstner, Week GAC51, 207 Dogwood Drive, Eutawville, South Carolina 29048-8892; Stephanie Nixon Mills, Week GAF09, 18630 Laramie Lane, Country Club Hills, Illinois 60478; Sherman E. Seaborn, Week GAC38, Post Office Box 5742, Anderson, South Carolina 29623; and Jerome B. Wells, Week GAE10, 8 Jeanette Court, Sharpsburg, Georgia 30277.
The said indebtedness has been and is hereby declared in default by reason of non-payment of said charges and assessments. The debts remaining in default, this sale will be made for the purpose of satisfying the same and all expenses of this sale, including attorney's fees.
Said property will be sold as the property of the named debtors subject to any and all ad valorem taxes, the right of redemption of any taxing authority, any matters which might be disclosed by a current and accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, security instruments and any other matters of record superior to the indebtedness described herein.
The sale will be conducted subject to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code.
The undersigned will execute a Deed Under Power of Sale to the purchaser at said sale.
