gpn14 HS Foreclosures NOTICE OF SALE UNDER POWER GEORGIA, LONG COUNTY Under authority of the powers of sale and conveyance contained in that certain Deed to Secure Debt given by PAUL W. COX to THE GLENNVILLE BANK & TRUST COMPANY, n/k/a GLENNVILLE BANK, dated October 10, 1997, the same being recorded in Deed Book 138, Pages 296-300, Long County Records, conveying the after-described property to secure a Note dated October 10, 1997, executed by PAUL W. COX, in the original principal amount of ELEVEN THOUSAND FIVE HUNDRED SEVENTY-FIVE AND 99/100 DOLLARS ($11,575.99), with interest thereon as set forth therein, there will be sold on the first Tuesday in October, 2015, within the legal hours of sale, before the Courthouse door in Ludowici, Long County, Georgia, at public outcry to the highest bidder for cash, the land conveyed in said security deed described as follows: All that certain lot, tract or parcel of land situate, lying and being in the 1672nd G.M. District of Long County, Georgia, containing .81 acre, more or less, and being described more accurately according to a plat thereof prepared by Hugh M Smiley, Long County Surveyor, dated July 14, 1997, and recorded in Plat Book 12, page 265, of the office of the Clerk of Superior Court of Long County, Georgia. Said lot being bounded now or formerly as follows: North by lands of Jackie C. and Arthur Lee Gibbs; South by lands of Birdie P. Nunnally; East by other lands of Prince A. Cox; and West by lands of Wayne Blocker. Said above referenced plat is incorporated herein by reference thereto for descriptive and all other purposes. Also conveyed herewith is a perpetual 30' access easement for ingress and egress to the above described property. Said easement is shown on the above referenced plat which is incorporated herein by reference thereto. Said property being a portion of a larger 12.42 acre tract of land better known as Tract # 1 on that certain plat dated December 26, 1985, and of record in the office of the Clerk of Superior Court of Long County in Deed Book 5, Page 67. Said Tract #1 being the same as that Prince Cox received by deed dated January 2, 1987 from Charlie Cox, et al., and recorded in Deed Book 70, Pages 270-294, in the office of said Clerk. Said .81 acre tract of land is the same as that Paul W. Cox received from Prince A. Cox by Warranty Deed dated July 18, 1997; said deed being of record in the office of said Clerk in Deed Book 134, Pages 293-294. The indebtedness secured by said Deed to Secure Debt has become in default as to principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed and the whole amount of said indebtedness is declared to be in default and immediately due and payable, and the above-described property will be sold for the purpose of enforcing payment of the indebtedness secured by said Deed to Secure Debt. A deed will be executed to the purchaser at said sale conveying title as authorized in said Deed to Secure Debt. The proceeds of said sale will first be applied to the payment of the indebtedness to Glennville Bank, other charges and the expenses of sale as provided in said Deed to Secure Debt including attorney's fees (notice of intent to collect attorney's fees having been given) and the excess, if any, as provided by law. Said sale and the deed made to the purchaser at said sale will be subject to any outstanding unpaid ad valorem taxes on said property (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
