gpn14 HS Foreclosures NOTICE OF SALE STATE OF GEORGIA COUNTY OF LIBERTY WHEREAS, there has been a default in the payment of the indebtedness secured by that certain Deed to Secure Debt dated May 19, 2014, executed by Coastal Mini Storage, Inc., Liberty Auction, Inc., Thomas E. Mattingly, Jr. and Lori E. Mattingly of Liberty County, Georgia, in the original principal amount of One Million Twenty Thousand and 0/100 ($1,020,000.00) Dollars, recorded in Deed Book 1821, pages 296-307, in the Office of the Clerk of Superior Court of Liberty County, Georgia; and WHEREAS, under the provisions of the said Deed to Secure Debt said indebtedness secured thereby has immediately become due and payable and remains in default. NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That pursuant to the terms of the original Deed to Secure Debt and the power of sale contained therein and the laws in such cases made and provided, after proper advertisement, the undersigned, on the First Tuesday in October, to-wit: October 6th, 2015, before the Courthouse door in Liberty County, Georgia, between the legal hours of sale, will expose for sale to the highest and best bidder for cash the following described property, to-wit: That tract of land known as the location of Coastal Mini Storage and other related businesses containing three and eight hundred ninety-three one-thousandths (3.893) acres in the City of Hinesville, 17th G.M. District of Liberty County, Georgia, situate on Fraser Circle and being divided by Hall Street into two parcels. PARCEL A: That parcel of land containing One and Four Hundred Twelve One-Thousandths (1.412) acres being bound on the North by Block D, Stewart Pines, now or formerly the property of The Waters Group; East by the right of way of Hall Street; South by the right of way of Fraser Circle; and on the West by lands of the Estate of Gallard McCartney; lands of REN, Inc., and lands of Bonnie Minchey. Said parcel includes Liberty County Tax Parcels 056A-076 and 055C-245 and expressly includes all improvements and figures to the realty. PARCEL B: That parcel of land containing Two and Four Hundred Eighty One One-thousandths (2.481) acres being bound on the North by lands of Claude and Loretta Dryden; East by lands of Kenneth and Mavis Howard; Southeast by lands of V & B Properties, LLC; South by the right of way of Fraser Circle; and West by the right of way of Hall Street. Parcel B is subject to the drainage easement along the easterly boundary and a fifteen foot utility easement along the southeast boundary as shown on the plat described below. Said parcel includes Liberty County Tax Parcels 056A-084-A; 056A-084; and 056A-083. The property expressly includes all improvements and fixtures attached to the realty. Said PARCEL A and PARCEL B have such location, metes, and bounds as shown on a plat dated April 28, 2014, of a survey completed April 22, 2014, by A.G. Wells, Jr. G.R.L.S. #1656, recorded in Plat Section P-74 page 2CD, Liberty County Deed Records, said plat being incorporated herein by reference. Together with all rights, easements, appurtenances, royalties, mineral rights, oil and gas rights, all water and riparian rights, ditches, and water stock, and all existing and future improvements, structures, fixtures, and replacements that may now, or at any time in the future, be a part of the real estate described above (all referred to as "Property"). TERMS: Cash, purchaser paying for title, Georgia transfer tax, and all ad valorem taxes and assessments that may be due on said property; the proceeds of this sale shall be applied as provided in said Deed to Secure Debt.
