gpn14 BC Foreclosures NOTICE OF SALE UNDER POWER Bryan County State of Georgia By virtue of a Power of Sale contained in that certain Deed to Secure Debt from RICHARD H. BRYAN and AMY M. BRYAN to E. B. MILES PROPERTIES, LLLP, dated May 30, 2014, recorded in Deed Book 1136, Page 275, in the office of the Clerk of Superior Court of Bryan County, Georgia, said Security Deed having been given to secure two Promissory Notes dated May 30, 2014, in the original principal amounts of ONE HUNDRED FIVE THOUSAND SEVEN HUNDRED FIFTY AND 00/100 ($105,750.00); and SIX THOUSAND SIX HUNDRED THIRTY AND 59/100 ($6,630.59) with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Bryan County, Georgia, within the legal hours of sale on October 6, 2015, the following described property: All that certain lot, tract or parcel of land situate, lying and being in the 19th G. M. District, Bryan County, Georgia, and containing 5.54 acres, being more particularly described as Parcel 10, Hopeful Acres Subdivision, as shown on that certain plat prepared by Princeton P. Pirkle, Jr., Georgia Registered Land Surveyor, dated August 15, 1987, and recorded in Plat Slide 391, Page 5, in the Office of the Clerk of Superior Court of Bryan County, Georgia. Said plat and the description thereon, insofar as it refers to the lands herein conveyed, is by reference incorporated herein for descriptive and all other legal purposes. Said conveyance is subject to those certain Restrictive Covenants dated March 20, 1990, and recorded in the Office of the Clerk of Superior Court of Bryan County, Georgia. Included with this conveyance is a 2000 Homes of Merit manufactured home, bearing serial numbers FLHML3F157923028A and FLHML3F157923028B. Subject also to all valid reservations, restrictions, easements and rights of way of record; together with all improvements located thereon. Said property is known as 2919 HIGHWAY 119 N, PEMBROKE, GA 31321, and is identified as Parcel No. 015-009-08, in accordance with the system of mapping and numbering presently used by the Bryan County Board of Tax Assessors. The indebtedness secured by said Deed to Secure Debt has been and is hereby declared due because of the default under the terms of said Deed to Secure Debt and Notes, including but not limited to the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorney's fees and all other payments provided for under the terms of the Deed to Secure Debt and Notes. E.B. MILES PROPERTIES, LLLP, ,by and through its Managing Partners Lila Miles Blocker and Ella Miles Lewis, is the current holder of said Deed to Secure Debt. Pursuant to O.C.G.A.
