STATE OF GEORGIA COUNTY OF LIBERTY NOTICE OF SALE UNDER POWER Because of a default in the payment of the indebtedness secured by that certain Security Deed, dated June 12, 2009, executed by Antoine Joseph to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. as nominee for New South Federal Savings Bank, recorded in Deed Book 1592, Page 685, Liberty County, Georgia Deed Records, and securing a Note in the original principal amount of $105,214.00, said Security Deed last having been assigned to GREEN TREE SERVICING LLC (KNOWN AS DITECH FINANCIAL LLC EFFECTIVE AUGUST 31, 2015, PURSUANT TO NAME CHANGE), the current holder thereof, has declared the entire amount of said indebtedness evidenced by the Note immediately due and payable and, pursuant to the power of sale contained in said Security Deed, will, on the first Tuesday in October, 2015 to-wit: October 6, 2015, during the legal hours of sale, before the Liberty County Courthouse door, sell at public outcry to the highest bidder for cash, the following described real property: All that certain lot, tract or parcel of land situate, lying and being in the 1458th G. M. District of Liberty County, Georgia, and being in the City of Hinesville, being known and designated as Lot No. 199-D, Mary L. Caines Subdivision, as shown and represented on that certain plat of survey made and prepared by Lamar Olliff Reddick, Georgia Registered Land Surveyor No. 1387, dated July 2, 1979, and being recorded in Plat Book 13, page 3, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northeasterly by Lot No. 198-C; Southeasterly by Lot No. 199-C; Southwesterly by the right of way of McDowell Road; and Northwesterly by Lot No. 199-E, all as shown on the above referred to plat of survey. The aforedescribed real property is also known as 656 McDowell Rd., Hinesville, GA 31313, according to the present system of numbering houses in Liberty County, Georgia. This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit as to the amount and status of the loan with the holder of the Security Deed, including but not limited to, a determination that the borrower has not reinstated the loan prior to the foreclosure sale.
