By virtue of the power of sale contained in the Security Deed by and between THOMAS A. BROWN, JR. and PABLO SANTANA, (“Grantorâ€) to NBANK, N.A. (“Granteeâ€) dated June 15, 2004, and recorded in Deed Book 35A, Page 529, Jackson County Records, held by FIRST COVENANT BANK, pursuant to that Purchase and Assumption Agreement among First Covenant Bank, nBank, N.A. and nBank Corp., dated June 22, 2007, conveying the realty described herein as collateral for the debt in the principal amount of $104,010.00 together with all late fees and interest from dates of execution at the rates provided therein on the unpaid balance; there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Clarke County Georgia or at such other place as sheriff's sales are conducted in said County, within the legal hours of sale on the first Tuesday of October, 2015, the realty being more completely described as follows:
All that tract or parcel of land lying and being in the 248th District, G.M. Jackson County, Georgia encompassing 12.70 acres, more or less, as shown on a Plat of Survey for Ronald A. Berryman, dated April 13, 1992, as prepared by Thomas Lynn Colbaugh, GRLS, and being more particularly described as follows: To find the true point of beginning commence at the intersection Cedar Rock Road and 60 foot road easement, from thence, leave Cedar Rock Road and proceed 1964.59 feet Northwesterly along said road easement to a point and THE TRUE POINT OF BEGINNING; thence proceed South 79 degrees 34 minutes 16 seconds West 356.34 feet to a point; thence North 05 degrees 31 minutes 18 seconds West 906.40 feet to a point; thence North 05 degrees 31 minutes 18 seconds West 40.00 feet to a point; thence North 25 degrees 43 minutes East 110.00 feet to a point along the centerline of Walnut River; proceeding down the centerline of said Walnut River North 66 degrees 06 minutes East 92.00 feet to a point; thence North 89 degrees 52 minutes East 199.00 feet to a point; thence North 69 degrees 59 minutes East 171.98 feet to a point; then leaving Walnut River proceed South 35 degrees 55 minutes 50 seconds East 216.88 feet to a point; thence South 18 degrees 15 minutes 16 seconds east 438.67 feet to a point; thence South 70 degrees 33 minutes 16 seconds West 346.26 feet to a point; thence South 01 degrees 55 minutes 19 seconds east 355.62 feet to a point; thence South 01 degrees 55 minutes 19 seconds East 30.00 feet to a point and the true point of beginning.
Said property bears the address Cedar Rock Road, Hoschton, Georgia 30548.
The debt secured by said Security Deed has been and is hereby declared due and payable because, among other possible events of default, of the borrower's failure to pay the interest and principal when due. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), and any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of Grantee, the party in possession of the property is Grantor or a tenant or tenants.
