By virtue of the power of sale contained in the Security Deed by and between EVAN MINSTER and KERRY MINSTER, (“Grantorâ€) to NBANK, N.A. (“Granteeâ€) dated December 23, 2004, and recorded in Deed Book 37L, Page 265, Jackson County Records, held by FIRST COVENANT BANK, pursuant to that Purchase and Assumption Agreement among First Covenant Bank, nBank, N.A. and nBank Corp., dated June 22, 2007, conveying the realty described herein as collateral for the debt in the principal amount of $125,010.00 together with all late fees and interest from dates of execution at the rates provided therein on the unpaid balance; there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Clarke County Georgia or at such other place as sheriff's sales are conducted in said County, within the legal hours of sale on the first Tuesday of October, 2015, the realty being more completely described as follows:
All that tract or parcel of land lying and being in the 245th and 248th District, G.M., Jackson County, Georgia, being Lot 69, Pod N, Traditions of Braselton, as per plat recorded in Plat Book 64, Page 97-98, in the office of the Clerk of Superior Court of Jackson County, Georgia records, which plat is incorporated herein by reference and made a part of this description.
Said property bears the address Lot 69N, Duncans Mill Circle, Jefferson, Georgia 30549.
The debt secured by said Security Deed has been and is hereby declared due and payable because, among other possible events of default, of the borrower's failure to pay the interest and principal when due. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), and any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of Grantee, the party in possession of the property is Grantor or a tenant or tenants.
