Notice of Sale Notice of Sale Under Power State of Georgia, County of Jackson Under and by virtue of the power of sale contained in a Security Deed from WILLIAM DONALD SORRELLS, JR. and DONNA SMITH SORRELLS to UNITED COMMUNITY BANK, dated May 13, 2005, recorded June 16, 2005, in Deed Book 39H, Page 55, Jackson County, Georgia records, said Security Deed being given to secure a Note from WILLIAM DONALD SORRELLS, JR. and DONNA SMITH SORRELLS dated May 13, 2005, in the original principal amount of Forty Thousand and 00/100 ($40,000.00) Dollars, with interest from date at a rate per cent per annum on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Jackson County, Georgia, within the legal hours of sale on the first Tuesday in November, 2015, the following described property: The following described lot, piece or parcel of land, situate, lying and being in the County of Jackson, State of Georgia, to wit: All that tract or parcel of land lying and being in the 455th District, G.M., Jackson County, Georgia, containing 3.18 acres, more or less, and designated as Lot 4 of The Pond Forks Estates, Phase 1, and being more particularly described and delineated according to a plat and survey prepared by Thomas Wood and Associates, Inc., certified by Thomas Wood, Georgia Registered Land Surveyor No. 1990, dated April 26, 1990, revised July 16, 1990, entitled “Final Plat for Pond Forks Estates,” said plat being of record in the Office of the Clerk of Superior Court of Jackson County, Georgia in Plat Book 29, Page 293; which said plat and the recording thereof are by reference hereto incorporated herein for a more complete and detailed description, subject to existing easements and rights of way for public roads and utilities now in use. There shall be no mobile homes allowed on said property and a modular homes must have permanents foundations, landscaping and garages. All single family residences will have a minimum of 1,500 heated square feet. There shall be no poultry or swine operations, cattle feed lots, garage or commercial auto repair shops or other obnoxious activities. There shall not be more than one animal per 1.5 acres of land unless housed inside full time. Being the same property conveyed to Don Sorrells a/k/a William Donald Sorrells, Jr., Donna S. Sorrells no tenancy listed by Deed from Arnold C. Cochran C. Ray Etheridge recorded 12/30/1992, in Deed Book 14Y, Page 249. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above; including but not limited to that certain Security Deed to Regions Mortgage, Inc. dated June 19, 2003, recorded in Deed Book 30V, Page 33, Jackson County, Georgia records.
