ADVERTISEMENT OF SALE UNDER POWER OF SALE IN DEED TO SECURE DEBT STATE OF GEORGIA COUNTY OF FRANKLIN Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Wendell R. Hart, dated July 8, 1997, recorded July 10, 1997 in Deed Book 299, Page 25, records of Hart County, Georgia; the Security Deed having subsequently been given to secure a Note dated July 8, 1997 in the original principal amount of Thirty Eight Thousand Five Hundred NO/100 Dollars ($38,500.00), with interest from date on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest and best bidder for cash before the Courthouse door at Hart County, Georgia, within the legal hours of sale on the first Tuesday in November, 2015, the following described property, to wit: All that tract or parcel of land, with improvements thereon, lying and being in the 1113th District, G.M., Hart County, Georgia, within the corporate limits of the City of Royston, CONTAINING 0.48 OF AN ACRE, more or less, being shown and designated on the below-described plat as Tract No. 3 (containing 0.19 of an acre, more or less), and Tract No. 4 (containing 0.29 of an acre, more or less), and being bounded, now or formerly, as follows: On the Northeast by Tract No. 2 on the below-described plat; on the Southeast by U.S. Route No. 29; on the Southwest by property of Brana; and on the Northwest by Tracts No. 6 and No. 5 on the below-described plat. Said tract being more particularly described on that certain Plat of Survey dated January 25, 1993, by Bartlett & Cash Land Surveyors, Inc., Georgia Registered Land Surveyors, "Survey for: Roger Hart" filed for record in Plat Book 2-E, Page 127, Public Land Records maintained in the office of the Clerk of the Superior Court for Hart County, Georgia. Reference is here by made to the aforesaid Plat of Survey and the record thereof for the purpose of locating the boundaries and dimensions of said tract and for all other purposes.Being a portion of that property conveyed by Warranty deed from William Bruce Williams and Robert Ross Lyons to Romeo M. Adams, dated March 28, 1997, and recorded in Deed Book 295, Pages 89-90, aforesaid records. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, non payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. Said property will be sold as the property of Wendell R. Hart and subject to the outstanding ad valorem taxes and/or assess ments, if any, and further subject to the outstanding balance of all liens superior to the Security Deed, if any.
