NOTICE OF SALE UNDER POWER GEORGIA, COLUMBIA COUNTY By virtue of the power of sale contained in that Security Deed from Gregory James Darr and Eric Lee Blackwell ("Grantor"), to John Wesley Fuller and Dew Land Development Co. ("Grantee"), dated July 2, 2009, and recorded in the Office of the Clerk of Superior Court of Columbia County, Georgia on July 14, 2009, in Book 7019, Page 47 (the "Security Deed"), said Security Deed securing that Promissory Note from Grantor to the order of Grantee dated July 2, 2009, in the original principal amount of THIRTY EIGHT THOUSAND AND NO/100 Dollars ($38,000.00), with interest at the rate as provided therein on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door in Columbia County, Georgia, within the legal hours of sale on the first Tuesday in October, 2015 (October 6, 2015), the following described property, with any improvements thereon (the "Property"): ALL that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Columbia, being shown and designated as Lot 59, Block "A", of Rolling Meadows Subdivision, on a plat recorded in the Office of the Clerk of Superior Court of Columbia County, Georgia, in Plat Cabinet "A", Slide 113, #1-#4; reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property is hereby conveyed subject to Protective Covenants and to any and all other easements and restrictions of record in the aforesaid Clerk's Office. Tax map and parcel number: 028 086 Said property being commonly known as 364 ANNIE LAURIE DRIVE, GROVETOWN, GEORGIA 30813. The debt secured by the Security Deed has been and is hereby declared due because of, among other possible events of default, failure to comply with the terms of the Security Deed and the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees. The Property will be sold on an "as is, where is" basis without recourse against Grantee and without representation or warranty of any kind or nature whatsoever by Grantee with respect thereto. The Property shall be sold as the property of Grantor, subject to all restrictions, easements and other matters of record that are prior to the Security Deed and to which the Security Deed is subject and to unpaid taxes and assessments, if any. The validity and finality of this sale as well as the delivery of a deed conveying title to this property as a result of said sale are subject to the following: 1) a final determination that a proper bankruptcy case has not been filed which would stay the sale; 2) a final determination that all required notices of federal tax liens which affect the title to this property have been timely and properly given to the Internal Revenue Service; 3) a final confirmation and audit as to the amount and status of the loan with the holder of the security deed; and 4) the recording of a proper transfer or assignment of the underlying Security Deed into the name of the foreclosing lender.
