NOTICE OF SALE UNDER POWER GEORGIA, COLUMBIA COUNTY By virtue of Power of Sale contained in the Deed to Secure Debt and Note from Randall S. Harvey, Sr. and Sandra M. Harvey ("Borrowers") to Peter Budwick, Jr. ("Lender"), dated January 28, 2014, which Security Deed is filed for record February 11, 2014 and recorded in Book 9268, pages 84-90 in the Office of the Clerk of the Superior Court of Columbia County, Georgia, the Lender has called the Note due and payable. Said Deed to Secure Debt being given to secure a Note of even date in the original principal amount of One Hundred Ten Thousand and No/100 Dollars ($110,000.00) with interest from date at the rate as provided therein on the unpaid balance until paid there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Appling, Columbia County, Georgia, within the legal hours of sale on November 3, 2015 the following property: All that tract or parcel of land, together with all buildings and improvements thereon, situate, lying and being in the State of Georgia, County of Columbia, being known and designated as Lot 1, Block B of Tiller Place Subdivision, as shown on a plat recorded in the Office of the Clerk of Superior Court of Columbia County, Georgia in Plat Book 8, page 30, and subsequently transferred to Plat Cabinet AA, Slide 148 #3. Reference is hereby made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property is known under the present system of street numbering in Columbia County, Georgia as 473 RACHEL DRIVE, EVANS, GA 30809. Said property is conveyed subject to any and all applicable easements, restrictions and covenants recorded in Deed Book 235, pages 334-338, and amended in Deed Book 244, pages 304-306, aforesaid Clerk's Office MAP/PARCEL NO.: 072A 279 The debt secured by the Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to comply with the terms of the Note, to include non-payment, as required by the Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees. To the best knowledge and belief of Lender, the above described property is in the possession of Randall S. Harvey, Sr. and Sandra M. Harvey.
