gpn11 NOTICE OF SALE GEORGIA, COLQUITT COUNTY. By virtue of a power of sale contained in that certain Commercial Real Estate Deed to Secure Debt from JULIAN S. THAGGARD, DOERUN GRAIN CO., LLC and PAIGE S. THAGGARD to AMERIS BANK, dated April 5, 2013, and recorded in Deed Book 1169, Page 334 et seq., in the Office of the Clerk of Superior Court of Colquitt County, Georgia, said Deed to Secure Debt having originally been given to secure that certain Promissory Note in the original principal amount of ONE MILLION FIVE HUNDRED THOUSAND and NO/100 DOLLARS ($1,500,000.00) of even date therewith, as well as all extensions, renewals and modifications thereof, together with any and all other indebtedness, of any type or description, then or thereafter owing by THAGGARD FARMS, JULIAN S. THAGGARD and PAIGE S. THAGGARD to AMERIS BANK, there will be sold by the undersigned, at public outcry, to the highest bidder for cash, before the courthouse door at Moultrie, Colquitt County, Georgia, within the legal hours of sale on the first Tuesday in October, 2015, the following described property: Tract 1:All that certain piece, parcel or tract of land situate, lying and being in Land Lot 41 of the 8th Land District of Colquitt County, in the City of Doerun, Georgia, more particularly described as follows:To find the point of beginning of the tract herein described commence at the intersection of the eastern boundary of the right of way of South Church Street with the northern boundary of the right of way of East Fincher Avenue; thence proceed North 88 degrees 41 minutes 02 seconds East a distance of288.27 feet along the boundary of East Fincher Avenue to the PONT OF BEGINNING; thence proceed North 00 degrees 44 minutes 41 seconds East a distance of 392.06 feet to a point; thence proceed North 33 degrees 58 minutes 09 seconds East a distance of 80.12 feet to a point located on the southwestern boundary of the right of way of Georgia Florida Railnet; thence proceed South 56 degrees 14 minutes 07 seconds East along the right of way of Georgia Florida Railnet a distance of 194.44 feet to a point; thence proceed South 02 degrees 12 minutes 23 seconds East a distance of 184.49 feet to a fence; thence proceed South 88 degrees 41 minutes 02 seconds West a distance of 188.13 feet; thence proceed South 02 degrees 12 minutes 23 seconds East a distance of 161.00 feet to the northern boundary of the right of way of East Fincher Avenue; thence proceed 88 degrees 41 minutes 02 seconds West along the right of way of Fincher Avenue a distance of 36.73 feet to the point of beginning of the tract herein conveyed. Said tract containing 1.306 acres according to a plat entitled Survey for Will Grantham, survey dated March 21, 2008, plat dated March 26, 2008, a copy of which is recorded in Plat Book 41 , Page 51A, in the Office of the Clerk of the Superior Court of Colquitt County, Georgia.Tract 1 being the same property conveyed to Doerun Grain Co., LLC by deed recorded at Deed Book 1003, Page 522, County records. Tract 2:81.37 acres in Land Lot 86 the 8th Land District of Colquitt County, Georgia, being more particularly shown on a plat of survey prepared by Larry W. Grogan, GRLS No. 1649, dated July 11, 2011, entitled, Survey for Julian Stacy Thaggard, recorded in Plat Book 42, Page 172B, Colquitt County records, which said plat and the record thereof are by reference incorporated herein and made a part hereof.Tract 2 being the same property conveyed to Julian S. Thaggard and Paige S. Thaggard by deed recorded at Deed Book 1119, Page 71, Colquitt County records. Tract 3:151.21 acres in Land Lot 99 of the 8th Land District of Colquitt County, Georgia, being more particularly shown on a plat of survey prepared by Larry W. Grogan, GRLS No. 1649, dated July 11, 2011, entitled, Survey for Earl R. Massey, Sammy K. Massey, Merrell M. Caner & Sherry M. Yarbrough, recorded in Plat Book 42, Page 173A, Colquitt County records, which said plat and the record thereof are by reference incorporated herein and made a part hereof.Tract 3 being the same property conveyed to Julian S. Thaggard and Paige S. Thaggard by deed recorded at Deed Book 1119, Page 72, Colquitt County records. Also to be sold shall be any and all fixtures attached to said tracts of real property. The indebtedness secured by the aforementioned Deed to Secure Debt has been and is hereby declared immediately due and payable in full because of the failure of THAGGARD FARMS, JULIAN S. THAGGARD and PAIGE S. THAGGARD to maintain payments upon said indebtedness owing to the AMERIS BANK in accordance with its terms. Said indebtedness remaining in default, this sale shall be made for the purpose of paying such indebtedness, as well as all expenses of this sale, including attorneys fees. The above-described property will be sold as the property of JULIAN S. THAGGARD, DOERUN GRAIN CO., LLC and PAIGE S. THAGGARD and will be sold subject to the following items which may affect the title to said property: all zoning and subdivision ordinances and/or regulations; matters which would be disclosed by an accurate survey or an inspection of the property; all real property ad valorem taxes or assessments, which may constitute liens upon said property; all liens which, under applicable law, would take priority over the Deed to Secure Debt described above; and all easements, restrictions, rights-of-way, security deeds or other encumbrances of record which have priority over the referenced Deed to Secure Debt.
