Strickland to Southwest Georgia Bank dated July 1, 2004, recorded July 13, 2004, in Deed Book 829, Pages 23-30, Colquitt County Records said security deed originally securing a note of even date in the original principal loan amount of $56,040.91; said original note and corresponding loan balance being renewed under a subsequent note as evidenced by a Modification of Deed to Secure Debt dated March 24, 2005 and recorded April 8, 2005 in Deed Book 860, Page 341-343, Colquitt County Records, said modification expressly given to secure said subsequent note of even date in the principal amount of $80,798.83; said original note and corresponding loan balance being renewed under a subsequent note as evidenced by a Modification of Deed to Secure Debt dated August 9, 2007 and recorded August 21st, 2007 in Deed Book 974, Page 338-344, Colquitt County Records, said modification expressly given to secure said subsequent note of even date in the principal amount of $106,151.67; and said original note and corresponding loan balance being renewed under a subsequent note as evidenced by a Modification of Deed to Secure Debt dated June 12, 2009 and recorded June 22nd , 2009 in Deed Book 1047, Page 376-382, Colquitt County Records, said modification expressly given to secure said subsequent Note of even date in the principal amount of $106,055.41, with interest from date at the rate provided in the note on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Colquitt County, Georgia, within the legal hours of sale on the first Tuesday in October, 2015, the following described property: That tract or parcel of land lying and being in Land Lot Number 239 in the Eighth (8th) Land District of Colquitt County, Georgia, and being in the Town of Funston, Georgia, more particularly described as follows: Beginning at a point on the North margin of State Highway 37 (Moultrie-Camilla Highway) 350 feet East of the Northeast intersection of State Highway 37 and North Manning Street (Funston-Sigsbee Road); thence run North 22 degrees 00 minutes East to lands of Mrs. Lennie Keen Baker; thence run South 67 degrees 00 minutes East along the South line of Mrs. Lennie Keen Baker a distance of 150 feet; thence run South on a line parallel to the East line of R.B. Anderson (West line of property herein described) to a point on the North margin of the Moultrie-Camilla Highway; thence, run West along the North margin of said highway to the point of beginning. This being the same tract of land conveyed to Grantor herein by Warranty Deed dated June 8, 2000 recorded in Deed Book 685, Page 001, Colquitt County records. Said property will be sold subject to any applicable restrictive covenants and/or easements of record and any taxes or assessments which may be a lien against said property. In addition said property will be sold subject to any matters which might be disclosed by an accurate survey and inspection of said property. The Debt secured by said Security Deed has been and is hereby declared due because of non-compliance with the requirements of the note and/or security deed, being more specifically without limitation, non-payment of loan.
