POPE NKA NAOMI GAIL HOLT to BANK OF LENOX dated OCTOBER 6, 2006, and recorded on OCTOBER 12, 2006, in DEED BOOK 933, PAGE 36, of the COLQUITT County, Georgia Records; as last assigned to GREEN TREE SERVICING LLC NKA DITECH FINANCIAL LLC, by Assignment dated JULY 22, 2015, and recorded on AUGUST 24, 2015, recorded at DEED BOOK 1244, PAGE 0508, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of FORTY SEVEN THOUSAND, SEVEN HUNDRED SEVENTY SEVEN Dollars and 91/100 ($47,777.91) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of COLQUITT County, Georgia, within the legal hours of sale on the first TUESDAY in OCTOBER, 2015, the following described property: One (1) acre, more or less, in Land Lot Number Four Hundred Forty-Three (443) in the 8th Land District of Colquitt County, Georgia bounded North by lands now or formerly of Motley; East by lands now or formerly of G. W. Plymel; South by lands now or formerly of W. B. Plymel (center of public road dividing); and West by lands now or formerly or W. B. Plymel (the dividing line being marked); being the one acre tract shown on plat of survey made by J. M. Leverett, C. E. entitled Property of W. B. Plymel, dated October 4, 1947, (revised April 30, 1956), and recorded in Plat Book 1, Page 510, in the Office of the Clerk, Superior Court, Colquitt County, Georgia, to which plat and record of same reference is expressly made for a more detailed description, said one (1) acre tract being in the Northeast corner of said plat. The tract hereby conveyed being the same tract conveyed to Raymond Plymel by W. B. Plymel under deed dated May 10, 1956, and recorded in Book 173, Folio 445, in the office of the Clerk of Superior Court of Colquitt County, Georgia. Also being the same property referenced by deed at Deed Book 430, Page 351, recorded in the Office of the Clerk of the Superior Court of Colquitt County, Georgia. The said tract is also identified as parcel C48/090 in the Colquitt County Tax Assessors Office and is also partially shown as Mrs. John Gibbs land on a plat recorded in Plat Book 22, Page 101, Colquitt County, records. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorneys fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
