NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY By virtue of the power of sale contained in that certain security debt from Downtown Baptist Sanctuary Church Incorporated to Provident Investment Corporation, dated December 28, 2011, filed for record December 28, 2011, and recorded in Deed Book 2943, Page 435, Glynn County, Georgia records, ("Security Deed"), said Security Deed securing a note in the original amount of $869,269.37 (as may have been previously or subsequently renewed, extended, and/or modified), there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, during the legal hours of sale on the first Tuesday of November, 2015 (being November 3, 2015), the following described property, to wit: All of that certain tract or parcel of land situate, lying and being in the City of Brunswick, in Glynn County, Georgia, and being more particularly described and identified according to that certain plat of survey for Life Community Outreach Ministries, Inc., prepared by Southeastern Land Surveyors, Inc., and certified by Norman G. Blood, Georgia Registered Land Surveyor No. 2360, under date of February 13, 2004 (field date: February 12, 2004; plat date: February 13, 2004), an original print of which is recorded in the office of the Clerk of the Superior Court of Glynn County, Georgia, in Plat Cabinet 1, as Folio 42-A, as follows, to-wit: Commence at the point of intersection of the northerly margin of the right-of-way line of "T" Street (50 foot right-of-way) with the easterly margin of the right-of-way line of Norwich Street (60 foot tight-of-way), said point of intersection being marked by 1/2 inch rebar as shown on said Blood plat of survey; and thence from said POINT OF BEGINNING running along the easterly margin of the right-of-way line of Norwich Street North 17 degrees 30 minutes 00 seconds West for a distance of 300.00 feet to a point marked by a concrete monument; thence turning and running North 72 degrees 30 minutes 00 seconds East for a distance of 330.00 feet to a point located along the westerly margin of the right-of-way line of Wolfe Street (45 foot right-of-way) and being marked by a rebar; thence turning and running along the westerly right-of-way line of Wolfe Street South 17 degrees 30 minutes 00 seconds East for a distance of 240.00 feet to a point marked by a 1/2 inch rebar; thence turning and running South 72 degrees 30 minutes 00 seconds West for a distance of 151.37 feet to a point marked by a 1/2 inch rebar; thence turning and running South 17 degrees 30 minutes 00 seconds East for a distance of 60.00 feet to a point located along the northerly margin of the right-of-way line of "T" Street and being marked by a nail set in root; thence turning and running along the northerly margin of the right-of-way line of "T" Street South 72 degrees 30 minutes 00 seconds West for a distance of 178.63 feet to the POINT OF BEGINNING. Reference is hereby made to the aforesaid Blood plat of survey and to the record thereof for all further purposes of description and identification of the real property hereby conveyed and for all other purposes. Said real property being a portion of Block "I" of the Day Tract and containing 2.064 acres, more or less, according to said Blood plat of survey. The above-described property is commonly known as 3010 Norwich Street, Brunswick, Georgia 31520 and/or 3018 Norwich Street, Brunswick, GA 31520. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due in the manner provided in the note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Any remaining balance will be distributed as provided by law. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
