Legal 248 Advertisement Of Sale Under Power Georgia, Upson County: By virtue of the power and authority contained in a Security Deed and under the power of sale contained therein, executed by Toby Selph to First Bank Of Pike, dated January 8, 2011, which is recorded in the Clerk's Office, Superior Court of Pike County, Georgia, in Deed Book 849, Page 85; said Georgia Security Deed and Security Agreement having been given to secure a Promissory Note dated January 15, 2013, with interest from date at the rate stated in said Promissory Note on the unpaid balance until paid, the undersigned will sell at public outcry to the highest bidder for cash at the courthouse in Zebulon, Pike County, Georgia, between the legal hours of sale on the first Tuesday in November, 2015 to-wit: November 3, 2015, the following real estate: All that tract or parcel of land containing 10.0 acres, more or less, lying and being in Landlots 181 AND 204 of the 8th Land District of Pike County, Georgia, and being more particularly shown and designated as 10.0 acres according to that certain plat of survey entitled “Property Survey For Tom Barrett And Associates, Inc.”, dated June 21, 1973, prepared by Kenneth Edward Presley, Georgia Registered Professional Land Surveyor, a copy of which said plat is recorded in plat book 4, page 87, Clerk's Office, Superior Court, Pike County, Georgia, and which said plat, together with the metes, bounds, courses and distances as shown thereon with respect to the said 10.0 acres, is by this reference incorporated herein in aid of this description as fully as if copied at length herein. LESS AND EXCEPT: All that tract or parcel of land containing 7.034 acres, more or less, lying and being in land lots 181 & 204 of the 8th Land District of Pike County, Georgia, and being more particularly shown and designated as 7.034 acres according to that certain plat of survey entitled “Property Survey for Emmitt V. Yeoman, Jr. & Clara Ann Dean Yeoman”, dated April 3, 1997, prepared by Gerald H. Bernhard, Georgia Registered Professional Land Surveyor, a copy of which said plat is recorded in plat book 14, page 61, Clerk's Office, Superior Court, Pike County, Georgia, and which said plat, together with the metes, bounds, courses, and distances as shown thereon with respect to the said 7.034 acres, is by this reference incorporated herein in aid of this description as fully as if copied at length herein. The net acreage of the subject property is 2.966 acres. Pg. 2, Adv. Of Sale (Foreclosure, Selph) The debt secured by said Security Deed and note has been and is hereby declared due and payable in full because of nonpayment of indebtedness secured thereby pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with the legal requirements of the Deed to Secure Debt and Note(s). The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt, including attorney's fees, and the remainder, if any, shall be applied as provided by law. To the best of the undersigned's knowledge and belief, the property is in the possession of and will be sold as the property of TOBY SELPH with a mailing address known as 1152 Blount Road, Meansville, GA 30256. The sale will be conducted subject: 1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and, 2) to final confirmation and audit of the status of the loan with the holder of the Georgia Security Deed and Security Agreement.
