Notice of Sale Under Power
STATE of Georgia County of FANNIN THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Deed to Secure Debt (Security Deed) from Sarah L. Arp and Donald M. Arp ("Grantor) to CountryPlace Mortgage, LTD. (Grantee), dated November 16, 2006, recorded in Deed Book 762, beginning at Page 645, Fannin County, Georgia Records, said Security Deed being given to secure a Note of even date therewith in the original principal amount of Ninety-eight Thousand, Eight Hundred, Sixty One and 64/100ths Dollars (U.S. $98,861.64), with interest from date at the rate provided therein on the unpaid balance until paid, the undersigned will sell at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in November, 2015 the following described property: All that tract or parcel of land lying and being in Land Lot 111 of the 8th District, 2nd Section, Fannin County, Georgia, being designated as Tract 2, containing 1.240 acres, more or less, as shown on plat of survey entitled Boundary Survey for Donald M. & Sarah L. Arp, dated June 18, 2006, by Josh S. Walton, R.L.S. No. 3016, and recorded in plat book D-351, at page 1, in the Office of the Clerk of Superior Court, Fannin County, Georgia, which said plat is incorporated herein by reference for a more complete and detailed description of said property. This being a portion of the property convened by deed recorded in Deed Book 56, page 481, said records. Also conveyed herewith is a 2006 Fleetwood manufactured home, being 28 feet x 60 feet Model 4484X/Xtreme and having Serial Number PH14-13836AB, which is permanently attached to and made a part of the real property. The debt secured by the Security Deed has been and is hereby declared due because of default under the terms of the Security Deed and Note, including, but not limited to, the nonpayment of the debt as and when due. The debt remaining in default, this sale will be made for the purpose of paying the same, all expenses of this sale, including attorneys fees and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to the following items which may affect the

Please understand that the secured party is not required by law to negotiate, amend, or modify the terms of the mortgage instrument. To the best knowledge and belief of the undersigned, the party in possession of the property is Sarah L. Arp or tenant or tenants. The property is more commonly known as 29 Tankersly Lane, Epworth, GA 30541. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
