CLASS:007 NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Security Deed (hereinafter “Security Deed”) from Jeff Brewer (hereinafter the “Grantor”) to Mortgage Electronic Registration Systems, Inc. as nominee for New South Federal Savings Bank, dated February 13, 2009, and recorded February 17, 2009, in Book 3425, Pages 348-359 of the records of the Clerk of Superior Court of Coweta County, Georgia Records; then assigned to Beal Bank by instrument recorded in Book 3611, commencing on Page 515, aforesaid records; then assigned by Beal Bank to Property Acceptance Corp. by instrument recorded in Book 3611, commencing on Page 517, aforesaid records; then assigned by Property Acceptance Corp. to LPP Mortgage Ltd. by instrument recorded in Book 3611, commencing on Page 519, aforesaid records; then last assigned by LPP Mortgage Ltd. to Cadles of Grassy Meadows II, L.L.C. (“hereinafter the “Holder”) on or about March 5, 2015, by Assignment of Security Deed recorded at Book 4190, Pages 417-419, aforesaid records, originally having been given to secure a Note from Jeff Brewer to New South Federal Savings Bank, in the original principal amount of $114,470.00 (hereinafter the “Note”), the following described real property will be sold by the undersigned at public outcry to the highest bidder for cash or certified funds before the Courthouse door at Coweta County, Georgia, within the legal hours of sale on the first TUESDAY in OCTOBER, 2015, to wit: All that tract or parcel of land, situate lying and being in Land Lot 256 of the 2nd Land District of Coweta County, Georgia, and being more particularly identified as Lot 7, Hines Woods, as shown on plat of survey of Hines Woods as recorded in Plat Book 83, Page 207, in the Office of the Clerk of the Superior Court of Coweta County, Georgia; to which plat reference is hereby made for a more particular and accurate description of the property conveyed herein. Also conveyed herein is a perpetual non-exclusive sixty foot access easement for pedestrian and utility and vehicular access, ingress and egress from and to Hines Road which sixty foot easement is more particularly identified as “60' access easement” as shown on the above referenced plat of survey for Hines Woods as recorded in Plat Book 83, Page 207, in the Office of the Clerk of the Superior Court of Coweta County, Georgia; to which plat reference is hereby made for a more particular and accurate description of the sixty foot access easement conveyed herein. The debt secured by said Security Deed has been and is hereby declared due and payable in full by reason of default under the terms and provisions of said Security Deed and the terms of the said Note, and all renewals, additions, and extensions thereof, and any other loan agreements secured thereby. The debt remaining in default, this sale will be made for the purpose of paying the indebtedness and interest thereon, together with any other indebtedness due and owing by Borrower or Grantor to Holder, Cadles of Grassy Meadows II, L.L.C., all expenses of this sale, including attorney's fees as notice of intent to collect attorney's fees having been given. Please understand that the Holder is not required to negotiate, amend, or modify the terms of the mortgage instrument. Said property will be sold subject to any outstanding ad valorem taxes including taxes which are a lien, but not yet due and payable, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, deeds to secure debt, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the Security Deed first set out above. To the best of the knowledge of Holder, title to said property is vested in the name of Grantor. Consequently, said property will be sold as the property of the Grantor.
