NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in a Deed to Secure Debt dated 23rd day of DECEMBER, 2014, from GARY B. FERGUSON JR. to JOHNNY J. JONES, recorded in Deed Book 1897, Page 111-115, said Deed to Secure Debt having been given to secure a promissory note of even date, in the original principal sum of $15,500.00, and last transferred and assigned to JOHNNY J. JONES REALTY, INC. recorded in Deed Book 1924, Page 156-157, interest from date as stated therein; the holder thereof will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at GILMER COUNTY, GEORGIA within the legal hours of sale on the first Tuesday in OCTOBER, 2015. The property is described as follows:
All that tract or parcel of land lying and being in original Land Lot 238 of the 6th District, and 2nd Section of Gilmer County, Georgia, designated as TRACT 21, CONSISTING OF 3.83 ACRES, as shown on plat of survey for BIG BEAR MOUNTAIN, INC. said plat, dated July 1984 by Donald O. Babb, G.R.L.S. No. 2029, recorded in Plat Book 12, Page 59, Gilmer County records, is incorporated herein by reference.
The debt secured by said Deed to secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
To the best information, knowledge and belief of the undersigned, the property is presently in the possession of GARY B. FERGUSON JR..
The property will be sold as the property of said GARY B. FERGUSON JR. and will be sold subject to all restrictions, liens, encumbrances, easements and other matter of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes of assessments relating to the property.
