NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY Under and by virtue of the Power of Sale contained in a Security Deed from JENNIFER C. FAGERLIE to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. AS NOMINEE FOR MORTGAGE INVESTORS CORPORATION dated OCTOBER 15, 2010, and recorded on NOVEMBER 8, 2010, in DEED BOOK 01280, PAGE 2138, of the RICHMOND County, Georgia Records; as last assigned to PLANET HOME LENDING, LLC, by Assignment dated MARCH 27, 2015, and recorded on APRIL 7, 2015, recorded at DEED BOOK 01479, PAGE 0649, aforesaid records; conveying the after-described property to secure a Note in the original principal amount of ONE HUNDRED SEVENTY FIVE THOUSAND, FOUR HUNDRED FIFTEEN Dollars and 00/100 ($175,415.00) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of RICHMOND County, Georgia, within the legal hours of sale on the first TUESDAY in OCTOBER 2015, the following described property: THE LAND REFERRED TO HEREIN BELOW IS SITUATED IN THE COUNTY OF RICHMOND, STATE OF GA, AND IS DESCRIBED AS FOLLOWS: All that lot, tract or parcel of land with improvements thereon, situate, lying and being in the County of Richmond, State of Georgia, being shown and designated as Lot 52, Block F, Section Four-B & Section Five, Southampton Subdivision, on a plat by Southern Partners, Inc., dated April 28, 2008 and recorded in Book 4, Page 160, in the Office of the Superior Court of Richmond County, Georgia. Reference is hereby made to said plat for a more complete and accurate description as to metes, bounds and location of said property. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, non-payment of the monthly installments as required by said Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
