G9-18897 O'Rourke/Thomas NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF CARROLL Under and by virtue of the Power of Sale contained in a certain Deed to Secure Debt from NICKOLAS O'ROURKE, Grantor, to LANNY THOMAS, Grantee, dated FEBRUARY 27, 2014, and recorded in Deed Book 1099, Page 62, Public Land Records of Haralson County, Georgia, said Deed to Secure Debt having been given to secure a Promissory Note, dated FEBRUARY 27, 2014, and other indebtedness of borrower to the lender, and undersigned being the present holder of said Note and Deed to Secure Debt, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Carroll County, Georgia, on the first Tuesday in October, to-wit: October 6, 2015, to the highest and best bidder for cash, the following described property: Parcel 1 All that tract or parcel of land lying and being in Land Lot 185 of the 8th District and 5th Section of Haralson County, Georgia, consisting of Two (2) Tracts (Tract II {9.401 acres}; Tract III {1.643 acres}) for a total of 11.04 acres as described on that certain plat of survey entitled "Survey for Lanny Thomas," dated 02/03/2014, prepared by Jason L. Hulsey, Georgia Registered Land Surveyor #3009, said survey being incorporated herein by reference thereto, said 11.04 acres being more particularly described as follows, to wit: To find the True Point of Beginning, commence at the common point located between Land Lot Numbers 185, 186, 191 and 192, said District and Section; thence run along the Southern land lot line of Land Lot 185 S86°56'00"E a distance of 1,298.42' to an iron pin and the TRUE POINT OF BEGINNING. Parcel 2 All that tract or parcel of land lying and being in Land Lot 185 of the 8th District and 5th Section of Haralson County, Georgia, containing 12.896 acres, more or less, and being more particularly described on that certain plat of survey entitled "Survey for Lanny Thomas," dated 08/24/06, prepared by J.L.H. Surveying, Inc., certified by Jason L. Hulsey, GRLS #3009, recorded on 09/01/06 with the Clerk of the Superior Court of Haralson County, Georgia at Plat Book 39, Page 39, said survey and the record thereof being incorporated herein and made a part of this description by reference thereto. Said property is known as 623 Kings Gin Road, Waco, Georgia 30182 The debt secured by said Deed to Secure Debt and note has been and is hereby declared due and payable in full because of default pursuant to the terms of said Deed to Secure Debt and Note. Notice has been given of intention to enforce provisions for collection of attorney's fees and foreclosure in accordance with requirements of Official Code of Georgia Annotated Section 44-14-162.2 and the terms of the Deed to Secure Debt and Note. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Deed to Secure Debt, accrued interest and expenses of the sale and other sums secured by the Deed to Secure Debt including attorney's fees, and the remainder, if any, shall be applied as provided by law. To the best of the undersigned's knowledge and belief the property is in the possession of NICHOLAS O'ROURKE, and said property will be sold as the property of NICHOLAS O'ROURKE, subject to any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
