NOTICE OF SALE UNDER POWER CONTAINED IN SECURITY DEED STATE OF GEORGIA, COUNTY OF Glynn Pursuant to a power of sale contained in a certain security deed executed by Patricia D. Miller, hereinafter referred to as Grantor, to First Bank Mortgage A Division of First Bank of Georgia recorded in Deed Book 2981, beginning at page 126, and re-recorded at Deed Book 2990, Page 239, of the deed records of the Clerk of the Superior Court of the aforesaid state and county, and by virtue of a default under the terms of said security deed, and the related note, the undersigned attorney-in-fact for the aforesaid Grantor (which attorney-in-fact is the present holder of said security deed and note secured thereby) will sell at the usual place of conducting Sheriff's sales in said county within the legal hours of sale, to the highest bidder on the first Tuesday in October 2015, all property described in said security deed including but not limited to the following described property: That leasehold interest in and to those certain lots, tracts, or parcels of land situate, lying and being in the County of Glynn, State of Georgia and in the City of Brunswick therein, and being described according to that certain plat of survey prepared by PB Copeland & Associates, signed by Payne B. Copeland, II, Georgia Registered Land Surveyor No. 2692, entitled "Plat to Show A Subdivision of a Parcel of Land Lying At the Corner of "K" Street & Tillman Ave., City of Brunswick, Glynn County, Georgia For: The Housing Authority of The City of Brunswick", dated April 29, 2009, filed and recorded on May 7, 2009, in Book 31, Page 118, in the Office of the Clerk of Superior Court of Glynn County, Georgia as all of Lot 1 containing 0.17 acres. Reference is hereby made to the aforesaid map and plat and the record thereof for all further purposes of description and identification and for all other purposes. Parcel #01-07250 Said legal description being controlling, however, the Property is more commonly known as: 2203 K Street, Brunswick, GA 31520 Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. This sale will be made subject to a Ground Lease Agreement recorded at Deed Book 2981, Page 98 in the Real Estate Records of Glynn County, Georgia and any interests contained therein, including but not limited to potential rights of redemption and. The sale will be subject to the following items which may affect the title: any outstanding ad valorem taxes (including taxes which are a lien but not yet due and payable); any matters which might be disclosed by an accurate survey and inspection of the property; any assessments, liens, encumbrances, zoning ordinances, restrictions, and all other matters of record superior to the said Security Deed. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
