NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in a Deed to Secure Debt dated 11TH day of JULY, 2011, from JOAN PAPADINIS and AUDREY M. GRACIDA to JOHNNY J. JONES, recorded in Deed Book 1681, Page 29-30, said Deed to Secure Debt having been given to secure a promissory note of even date, in the original principal sum of $31,500.00, and last transferred and assigned to JOHNNY J. JONES REALTY, INC. recorded in Deed Book 1914, Page 54-71, interest from date as stated therein; the holder thereof will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at GILMER COUNTY, GEORGIA within the legal hours of sale on the first Tuesday in OCTOBER, 2015 The property is described as follows:
ALL THAT TRACT or parcel of land lying in the 26th district, 2nd Section of Gilmer County, Georgia, and being 3.56 acres of Land Lot 36, designated as Tract 31 as shown by survey plat for DAVIS CREEK FARM by Larry H. Rogers, GA RLS , dated November 6, 1986 and recorded in Plat Book 15, Page 48, Gilmer County Records, to which reference is hereby made for incorporation herein as provided by OCGA Section 44-2-28.
THIS conveyance is made subject to a 40 foot road right of way and utilities easement as shown on said plat.
The property has the current physical address of 669 Charlotte's Web Dr.
The debt secured by said Deed to secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
To the best information, knowledge and belief of the undersigned, the property is presently in the possession of JOAN PAPADINIS and AUDREY M. GRACIDA.
The property will be sold as the property of said JOAN PAPADINIS and AUDREY M. GRACIDA and will be sold subject to all restrictions, liens, encumbrances, easements and other matter of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes of assessments relating to the property.
