STATE OF GEORGIA COUNTY OF GILMER NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in a Deed to Secure Debt dated 25TH day of JUNE, 2010, from JESSICA ROSE BYERS to JOHNNY J. JONES, recorded in Deed Book 1617, Page 279-281, said Deed to Secure Debt having been given to secure a promissory note of even date, in the original principal sum of $28,150.00, and last transferred and assigned to JOHNNY J. JONES REALTY, INC. recorded in Deed Book 1914, Page 54-71, interest from date as stated therein; the holder thereof will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at GILMER COUNTY, GEORGIA within the legal hours of sale on the first Tuesday in OCTOBER, 2015. The property is described as follows: ALL THAT TRACT or parcel of land lying and being in the 26th District, 2nd Section of Gilmer County, Georgia, and a part of Land Lot 74 and designated as Lot 230 of Rodgers Creek Properties Unit V, as shown on survey of Bums L. Jeffries, RLS #2036, and recorded in Plat Book 17, Page 250 Gilmer County Records to which reference is hereby made for a more complete metes and bounds description as provided by Section 44-2-28 Official Code of Ga. Ann. (29-423 Ga. Code Ann.) THIS CONVEYANCE is subject to the Declaration of Covenants, Conditions, and restrictions for Rodgers Creek Properties, dated August 25, 1988 (the CCRs), recorded in Deed Book 229, page 271, Gilmer County Records. Also conveyed are all improvements placed upon the property including a 1976 doublewide Pendix mobile home serial # 2905 A&B. The property has the current physical address of 334 Bartox Dr., Ellijay, GA 30540. The debt secured by said Deed to secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. To the best information, knowledge and belief of the undersigned, the property is presently in the possession of JESSICA ROSE BYERS. The property will be sold as the property of said JESSICA ROSE BYERS and will be sold subject to all restrictions, liens, encumbrances, easements and other matter of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes of assessments relating to the property.
