NOTICE OF SALE UNDER POWER GEORGIA, GLYNN COUNTY Under and by virtue of the Power of Sale contained in that certain Consumer Deed to Secure Debt from Joseph James Parker and Gina D. Parker (collectively, "Grantors") to The Coastal Bank of Georgia, a division of Synovus Bank ("Grantee") dated April 28, 2003, filed and recorded May 15, 2003, in Deed Book 1135, Page 196, Glynn County, Georgia Records, as modified by that certain Modification of Security Deed dated July 31, 2012, filed and recorded August 15, 2012, in Deed Book 3035, Page 215, aforesaid records (as modified, the "Security Deed"), conveying the after-described property to secure that certain Home Equity Line of Credit Agreement dated April 28, 2003, from Grantors payable to Grantee in the original principal amount of Forty Thousand and No/100 Dollars ($40,000.00), with interest thereon as set forth therein (the "Note"), there will be sold at public outcry to the highest bidder for cash before the courthouse door of Glynn County, Georgia, within the legal hours of sale on the first Tuesday in September, 2015, the following described property: All of those certain lots or portions of lots situate, lying and being in the City of Brunswick, Glynn County, Georgia, described and identified according to the well known maps and the plan of said City as all of Lot Number 681, the southerly 33.34 feet of Lot Number 680 and the northerly 15 feet of Lot Number 682, all in South End Subdivision, and being more particularly described and identified as follows, to-wit: commencing at a point on the easterly line of Union Street 85 feet northerly (measured along said easterly line of Union Street) from the point of intersection with the northerly line of Fourth Avenue with said easterly line of Union Street and from said beginning point continuing in a northerly direction along said easterly line of Union Street for a distance of 98.34 feet; thence in an easterly direction and along a line parallel to said northerly line of Fourth Avenue for a distance of 160 feet to the westerly line of an alley; thence in a southerly direction along said westerly line of said alley for a distance of 98.34 feet; and thence in a westerly direction and along the line parallel to said northerly line of Fourth Avenue for a distance of 160 feet to the point or place of beginning. Said real property is the same property fully described and identified in conveyances to Mrs. Ethel Moreira, one being dated June 22, 1951, and recorded in the public records of Glynn County, Georgia, in Deed Book 6-W, Page 435, and the other being dated September 22, 1951, and recorded in said public records in Deed Book 6-X, Page 608. Reference is hereby made to said conveyances and to the record of each for further purposes of description and identification and for all other purposes. The indebtedness secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given as provided by law). The property will be sold for cash or certified funds and subject to any and all matters of record superior to said Security Deed, outstanding ad valorem taxes, any matters which might be disclosed by an accurate survey and inspection of the property, zoning ordinances, restrictions, covenants, and easements against the property, if any, and unpaid water and sewage bills that constitute liens against the property, whether due and payable or not yet due and payable. The sale will be conducted as set forth herein subject to (1) confirmation prior to the sale that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit prior to the sale of the status of the loan with the holder of the Security Deed. Grantee reserves the right to sell the property in one parcel or as an entirety, or in such parcels as Grantee may elect, as permitted in the Security Deed. The following information is being provided in accordance with O.C.G.A. 44-14-162.2. The Coastal Bank of Georgia, a division of Synovus Bank is the secured creditor under the Security Deed and loan being foreclosed. The following entity shall have full authority to negotiate, amend, and modify all terms of the above-described Security Deed and associated Note on behalf of the secured creditor: The Coastal Bank of Georgia, a division of Synovus Bank, Attn: Foreclosures, 463719 SR 200, Yulee, FL 32097, (904) 491-7247. O.C.G.A. 44-14-162.2 states in pertinent part that, "nothing in this subsection shall be construed to require a secured creditor to negotiate, amend, or modify the terms of a mortgage instrument." To the best of the undersigned's knowledge and belief, the property is located at 308 Union Street, Brunswick, Glenn County, Georgia 31520 and the parties in possession of the property are Joseph James Parker and Gina D.
