CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA Under and by virtue of the power of sale contained with that certain Security Deed dated October 12, 2004, from Steven L. Martin to Mortgage Electronic Registration Systems, Inc., as nominee for American Freedom Mortgage, Inc., recorded on October 22, 2004 in Deed Book 2611 at Page 340, Coweta County, Georgia Records, having been last sold, assigned, transferred and conveyed to THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS SUCCESSOR INDENTURE TRUSTEE TO JPMORGAN CHASE BANK, N.A., AS INDENTURE TRUSTEE FOR THE CWABS REVOLVING HOME EQUITY LOAN TRUST, SERIES 2004-S a/k/a The Bank of New York Mellon f/k/a the Bank of New York, as successor Trustee to JPMorgan Chase Bank, N.A., as Trustee for the Holders of CWABS Revolving Home Equity Loan Trust, Series 2004-S, Revolving Home Equity Loan Asset-Backed Notes, Series 2004-S by Assignment and said Security Deed having been given to secure a note dated October 12, 2004, in the amount of $123,500.00, said note being in default, the undersigned will sell at public outcry during the legal hours of sale before the door of the courthouse of Coweta County, Georgia, on September 1, 2015, the following described real property (hereinafter referred to as the "Property"): ALL THAT CERTAIN TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN LAND LOT 271 OF THE SECOND LAND DISTRICT OF COWETA COUNTY, GEORGIA, BEING LOT 2 OF CALICO CORNERS SUBDIVISION, AS PER PLAT OF RECORD AT PLAT BOOK 74, PAGES 188-189, COWETA COUNTY, GEORGIA RECORDS. REFERENCE TO SAID PLAT IS HEREBY MADE FOR A MORE COMPLETE AND ACCURATE DESCRIPTION OF THE PROPERTY HEREIN DESCRIBED. THE ABOVE-DESCRIBED PROPERTY IS CONVEYED SUBJECT TO DECLARATION OF COVENANTS AND RESTRICTIONS OF RECORD AT DEED BOOK 1780, PAGE 487, COWETA COUNTY, GEORGIA RECORDS, AND ALL AMENDMENTS THERETO. The debt secured by the Security Deed and evidenced by the Note and has been, and is hereby, declared due and payable because of, among other possible events of default, failure to make the payments as required by the terms of the Note. The debt remaining is in default and this sale will be made for the purposes of paying the Security Deed, accrued interest, and all expenses of the sale, including attorneys' fees. The property, being commonly known as 103 Calico Loop, Grantville, GA, 30220 in Coweta County, will be sold as the property of Steven L Martin, subject to any outstanding ad valorem taxes (including taxes which are a lien and not yet due and payable), any matters affecting title to the property which would be disclosed by accurate survey and inspection thereof, and all assessments, liens, encumbrances, restrictions, covenants, and matters of record to the Security Deed.
