STATE OF GEORGIA COUNTY OF PIERCE NOTICE OF SALE UNDER POWER IN SECURITY DEED Under and by virtue of the power of sale in that certain Security Deed from Roy Kyle Crosby (hereinafter referred to as Grantor), to PrimeSouth Bank, (Grantee), dated July 27, 2007 and recorded in Deed Book 640, Pages 69-74, Pierce County, Georgia records, and modified in that certain Modification of Deed to Secure Debt from Roy Kyle Crosby to PrimeSouth Bank, dated July 27,2012, recorded in Deed Book 798, Pages 23-25, Pierce County Georgia records, and in the Deed to Secure Debt, dated September 19, 2007, recorded in Deed Book 642, Pages 201-208, Pierce County Georgia records, and modified in that Modification of Deed to Secure Debt dated December 4, 2008, recorded in Deed Book 691, Pages 159-161, Pierce County Georgia records, and in that Modification of Deed to Secure Debt dated July 27,2012, recorded in Deed Book 798, Pages 26-28, Pierce County Georgia records (collectively referred to as the Security Deeds), said Security Deeds having been given to secure a Promissory Note, dated March 13,2014, in the original principal amount of $361,750.02, and a Promissory Note dated March 13, 2014, in the original principal amount of $31,702.90 (the Notes) with interest from date thereon at the rate specified therein on the unpaid balance until paid, there will be sold by the undersigned at public outcry, during the legal hours of sale before the door of the Courthouse of Pierce County, Georgia, on the first Tuesday in September, 2015, to wit, September 1,2015, to the highest and best bidder for cash the following described property: TRACT 1: That tract or parcel of land in Land Lot 227, 9th Land District, Pierce County, Georgia and consisting of approximately 2.5 acres and being the west one-half of Lot 25 of Alabaha Acres SubdiVision, a plat of which is recorded in the office ofthe Clerk of Pierce County, Georgia. For a more particular description ofthe tract, begin at the southwestern corner of said Lot 25, marked by an iron post, which is the point or place of beginning, thence proceed South 75 degrees 17 minutes East for a distance of 317.895 feet to an iron post; thence North 14 degrees 43 minutes West for a distance of 320.50 feet to an iron post; thence North 75 degrees 17 minutes West for a distance of 364.235 feet to an iron post; thence South 1 degree 23 minutes East for a distance of 333.50 feet to the point of beginning. TRACT 2: All that tract or parcel of land, situate, lying and being in the Land Lot 227 of the 9lh Land District of Pierce County, Georgia and being more particularly described as follows. Beginning at the Northwest corner of Land Lot 227 run, thence in a Southerly direction along the Western margin of Land Lot 227 a distance of 732.93 feet to a point, and with this as the point or place of beginning, run thence South 1 degree 30 minutes East a distance of 589 feetto a point, run thence South 1 degree 30 minutes East a distance of 589 feet to a point, then run South 75 degrees 17 minutes East a distance of 332.27 feetto a point; run thence North 11 degrees 56 minutes Easta distance of543.66 feet to a point, thence run North 74 degrees 46 minutes a distance of 381.1 0 feet to a point; thence run North 62 degrees 14 minutes West a distance of 90.35 feet to a point; said point being the point or place of beginning being 5.000 acres, more or less and designated as Tract 27 of Alabaha Acres according to a survey prepared by John E. Dykes, Georgia Registered Land Surveyor#585, for the Bonanza Land Company of Georgia and being dated February 28, 1974, and recorded with the clerk of Superior Court of Pierce County, Georgia, reference being made to said plat for all proper purposes. TRACT 3: All that tract or parcel of land situate, lying and being in Land Lot 381, 9th Land District, Pierce County, Georgia, containing 342.075 acres, more or less, as shown on a plat of survey prepared by Charles H. Tomberlin, R.L.S., dated August 21,2007, recorded in the Office ofthe Clerk of the Superior Court of Pierce County in Plat Book 18 at page 181; reference to which plat is hereby made for a more particUlar description of said property. Being a portion ofthe property conveyed to Plum Creek Timberlands, L.P. from Plum Creek Timber Company, Inc. by deed dated the 6th day of October, 2001, identified therein as Tract 6, and recorded in the aforesaid office in Deed Book 404 at page 271. TOGETHER WITH all the improvements erected on the property, and all easements, rights, appurtenances, rents, royalties, mineral, oil and gas rights and profits. water rights and stock, and all fixtures a part of the property, replacements and additions. The indebtedness secured by said Security Deeds and Notes have been and are hereby declared due and payable in full because of Grantors failure to make payment of principal and interest required in the Notes and the Security Deeds. Notice has been given of intention to enforce provisions for collection of attorneys fees and offoreclosure in accordance with legal requirements and the terms of the Security Deeds and Notes. The indebtedness remaining in default, the sale will be made for the purpose of applying proceeds thereof to the payment of the indebtedness secured by the Security Deeds, accrued interest and expenses of the sale and other sums secured by the Security Deeds including allorneys fees, and the remainder, if any, shall be applied as provided by law. Tothebest knowledge andbelief ofthe undersigned thepropertywill besoldastheproperty of Roy Kyle Crosby subject to outstanding ad valorem taxes, street improvements and other superior matters of record if any.
