NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in a Deed to Secure Debt dated 23rd day of August, 2010, from D&V Productions LLC to Johnny J. Jones, recorded in Deed Book 1626, Page 477-479, said Deed to Secure Debt having been given to secure a promissory note of even date, in the original principal sum of $5,000.00, and last transferred and assigned to JOHNNY J. JONES REALTY, INC. on April 27, 2015, recorded in Deed Book 1914, Page 54-71 interest from date as stated therein; the holder thereof will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at Gilmer COUNTY, GEORGIA within the legal hours of sale on the first Tuesday in September 2015, The property is described as follows:
All that tract or parcel of land lying in the 11th District, 2nd Section of Gilmer County, Georgia, and a part of land Lot 103, and designated as LOT C-155, of EAGLES MOUNTAIN RESORT, Unit 49, as shown on survey of Burns L. Jeffries, RLS # 2036, recorded in Plat Book 14, Page 48, Gilmer County Records, to which reference is hereby made for a more complete metes and bounds description as provided by Section 44-2-28 Official Code of Ga. Ann. (29-423 Ga. Code Ann.).
Subject to all valid restrictions of record.
The debt secured by said Deed to secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
To the best information, knowledge and belief of the undersigned, the property is presently in the possession of D&V Productions LLC.
The property will be sold as the property of said D&V Productions LLC and will be sold subject to all restrictions, liens, encumbrances, easements and other matter of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes of assessments relating to the property.
